Attributes of a Successful Loan Signing Agent

The last post prompted me to post a list of qualities that I believe are critical to be successful in this business, and I think these qualities are what catapults people in a class of their own. If you're focused on the task, and truly committed to this work as a career, you probably possess most of these characteristics. On the other hand, there are people in this business who have not been as committed, rather do it as a hobby and accept low fees from companies most of us would not work for. Hence, whining and wanking.

I hope your holiday season is the best ever! We just might have swimsuit weather here on the Central Coast. I am on my way to my family's home in Ojai to open gifts this evening and a great dinner prepared by my brother who survived quadruple bypass surgery in August. He's on a "natural" course of eating healthily. So no gravy and hi carbs for us! A long hike in the mountains will be great exercise from being trapped with my journal, seal and long lines of traffic to try to get any where around town this week.

In September 2011, 4G came to Santa Barbara. We have a strong population of hi tech brainiacs here in the county, startups for cloud computing technology, etc. So I thought I would like into it, I'm about as non tech as a fence post. So off I go to Best Buy to learn more about 4G. It's hot. I committed to a two year contract because I can kick the 3G that I acquired with Ipad2 a couple of weeks ago, and on Friday, I also acquired a Dell laptop Intel 7, 8 GB ram, 256 GB hard drive 17 inch screen cuz the eyes ain't what they once were when I started this crazy biz. Yesterday I had a signing in the middle of nowhere, you know, make a right on rural highway at two pine trees and strawberry fields, travel 3/4 of a mile til you get to mobile home in the middle of the Y, make a second right, travel two miles to a gate enter gate code and make left up the mountain, a second Y, take another left and wind up the mountain til you reach the top, park in front of the barn and we'll meet you...we've just finished a fox hunt ride, see you promptly at 3pm. Perfect. Is there Verizon connectivity if I become lost? Yes, and we have 4G, halleluja. There is civilization in the middle of nowhere. They are wireless. You can see Vandenberg AFB from their mountain home. We got done just in time for them to go to a Wine Box party. I went on to my next assignment, feeling optimistic about my investmet in the new technology, which probably at this writing is not all that new. Hard to keep up!

So, I made a good biz decision. Connectivity is key to doing this biz. Sometimes I'm sitting in a gas station bathroom, and my phone dies because the cinderblocks are so thick, I lose calls. But the 4G stays with you, according to the BB Geek Squad rep.

There is hope for me in the high tech arena, I have the tools now, let's see how much they help.

My humblest apologies to any of you who received an email from my yahoo account re. whatever it was....meds, enhancements, etc. Two people emailed me today to let me know my account was hacked, I have over 20,000 people in contacts. The good part is that I now know whose email is invalid due to company closure, layoff, etc. I am cleaning up my contact folder.

What does one do after their email account has been hacked? I know YAHOO.com knows, they are working in the back end trying to remedy this. Anyone else had this dreadful experience, what did you do?

Brenda asked this question in July. Here we are pre-Black Friday, I think sales will go through the roof.

I purchased one last week on a rainy night when traffic was heavy and daunting after a long day. I have been impressed with connection speed. I took it on a flight to Iowa recently and used it quite a bit. I hear there is a remote printing app. Wondering what any one else is using their ipad for in support of our NSA business.

Got a call to do a signing this morning and I would have documents in 30 minutes. I forgot about it until I was having a late dinner in town. Phone rings, documents are in my email in a few minutes. Sorry for the delay.

Came home and crashed without looking at the email on my laptop. It's a modification, I'm to collect two checks, one fo $1500 and the other....

I just emailed them and sent it back to them. I don't do this kind of work. Can you believe people are still falling for this crap?

It started yesterday, all the halloween festivities, people dressing up for the event walking around downtown. Also, the CHP is posted every five miles along the 101 corridor looking for revenue on the backs of every motorist they can write up. So be safe out there. I'm staying home this weekend and taking measurements for a new roof, heating system upgrade for Uncle Sam's tax credit, solar panels too, and starting on the kitchen remodel.

Can't wait. I had a rock and roll month. Who knows what November will be like with interest rates jumping up half a point. I think they will come down again.

Monday, Hallow's Eve, I will be just as busy as I was last week with the over flow of people who couldn't sign this past week. Lots of loans still coming down the pike that have been in process for several months.

Got a call tonight as I'm finishing up 8pm signing. I was able to tell him I'm available, but can't take the job, because it's common knowledge he doesn't pay his notaries. I hope you all get paid who are owed for work, pain and suffering.

Listening to First Business news, I just heard Peter Ticktin, Florida attorney specializing in foreclosures, says there is a foreclosure tsunami coming across the nation. So many people not paying their mortgage debt in his country. Like the snake that ate an elephant. Homeowners must go through the process of foreclosure to settle the debt. That means more people taking walks from their homes, after they live in them as long as possible without making payments.

Far from over, but we're not on the verge of another recession???? hmmmm.
 
 
Going thru a divorce

Friday night, I did the first part of a two part signing, couple in the process of divorce, hate each other's guts, multimillion $$ property being refinanced for a savings of $800 a month. Today I'm supposed to meet the husband, WHO HASN'T EVEN SEEN HIS DOCUMENTS YET, and he wants to study them. I say, fine, I'll leave them with you and you can get them back to title at your leisure, but they have to sign before monday or rate lock expires. He says, well, nothing is happening until I'm satisfied the loan is a solid deal, and the house won't get paid for unless I sign. I am agreeing to notarize his signature on the critical documents, I tell him if he doesn't want the loan, then don't return the package.

For crying out loud, his children have to live somewhere. What a turkey~it's just like I'm going through his divorce too. No wonder she gave him the boot...

So today I'm going to the vineyard/winery that he manages and if he gives me any crap, I'll just go taste so varietal reds and call it "experience". What a way to spend my Sunday, huh?
 
 
Busy season promises to stay that way the rest of the year

Under 4% 30 years, 3.25% for 10 year! I had a 3.5% yesterday on 15 year refi with WF. I'm busier than a fly on a bull's tail on a hot summer day.

So with all of this going on, I'm getting ready to (drum roll) sign up for medicare 90 days before my 65th birthday. I'm looking at supplemental plans. What plans have some of you signed up for, and does this supplemental plan vary in costs from state to state? I'm thinking CA will be higher, is that true from your experiences?

Well, it's been a wild ride, if any one had told me I would reach this milestone and still be working like I did when I was in my 30s, 40s and 50s, I would have said, no I'll be walking around my yard with pruners in my hand and a sun hat listening to my favorite tunes watching the grass grow.

But that ain't the case! I'm wondering if I will ever retire, even semi?!?!

In my area, it's Chase, WF, ML Wealth Management (owned by BofA), CU's, Union Bank, our local lenders who are smaller and US Bank.

I haven't seen a conventional BofA refi in months. I think they are trying to grasp how to handle all the nonperforming loans they have on their plate.

Is California the only state that requires fingerprints in notary's journal for deeds and POA's? Can you please respond if your state also requires fingerprints for these document signings? Also, are any other states now requiring notary's be live scanned for notary commission?
 
 
Notary Service Fees that Stink

You'll love this!

We at SL have requirements for all of our notaries. Yes, we charge differently than what you do only because we have so many notaries out there charging around the same price which makes our notaries and us business. It is unfortunate that you will not be working with us, but we here at SL understand.

So all you knuckleheads and idiots out there working for less than $100, as low as $45 to $60 for loan refi packages, this is the result of your toil. SHAME ON YOU! You are eroding and defouling our pool.

This was in response to my response when I was told my fees are WAY TOO HIGH!

Oh my, that is quite a reduction by more than 50%. Well, I guess I won't be your preferred notary in Santa Barbara . I'm afraid this reduction is far below my average signing fee of $125. It was once $175, but of course, things have changed since 2007. I've modified my fees to accommodate industry conditions.



If you ever need a top drawer notary in Santa Barbara county, as well as the entire Cental Coast , I'm here for you. I'm sure you'll find someone who is willing to do this work for these low fees, it's like anything else, you get what you pay for. I could not possibly stay in this business at these rates with the cost of living here on the central coast, as well as the cost to do this business. Of course, with my larger, long-standing clients who pay the going rate for notary loan signing accommodations, I could not possibly accept these fees and the time it would take away from better opportunities. My reputation as a top-level professional is unsurpassed in my area, I know this because my clients tell me, but also I do a lot of damage control where other notaries have dropped the ball, are no shows, or are simply incompetent.

MY E&O insurance premium, office rent, high speed internet access, scanning and other high tech office equipment, printer, paper and toner are a big part of my expense load. Most of my work is for Premium Title Companies across the nation. I also work directly for lenders who have very high profile clients and cannot risk any missteps in the final signing and notarization of their documents, resulting in loss of rate locks and client loyalty. I can see that your firm is willing to settle for less experienced, knowledgeable and industry savvy people to handle your clients' valuable documents.

I have some friends who have stopped making their mortgage payments. They've hired a company help them avoid foreclosure, the second lender has agreed to forgive 75% of the amount in delinquency and modify the interest rate and add the other 25% owed to the back of the loan.

The first, however, is with INDYMAC, now One West, owned by Goldman Sachs employees. I have seen many of the defaulted loans at the courthouse steps revert to the beneficiary.

Here's the kicker. One of the documents is an Assignment of Note and Mortgage. The person helping my friends through this process asked them to sign and have three witnesses sign with an imprint of their right thumb next to their signature on the document BECAUSE, are you ready?

A document witnessed and signed in this manner CARRIES MORE WEIGHT IN A COURT OF LAW THAN A NOTARIZED DOCUMENT.

I've been trying to get my friends to take all their documents and filings to the FBI mortgage fraud unit here on the central coast, and they are still waiting to see what happens with their foreclosure. They have received the notice of default, the next step is the NOTICE OF TRUSTEES sale, which will occur 20 days following the 90 day NOD timeline.

I told them that the fraud unit, the CA AG and the SOS would all have a field day with this company, what do you all think? Am I just working too hard, or does this seem incredibly senseless to you too? Your thoughts please.

1) No more Esignings during this refi flurry on the heals of news that rates are below 4%
Too unpredictable for logistical errors, connectivity issues, borrower late and not willing to sit thru the difficult process
2) No, Mr. Borrower,you're not the only appt I have today. Please be prompt and have a copy of your DL available to be returned for the loan funder. Please allow at least 30 minutes for the signing, perhaps 45 minutes to an hour. Do you have a large table we can sit at with adequate lighting so we will be sure to sign in all the right places? (many people live in a cave, I'm discovering!)
3) The name on your docs must match the name on your ID, in order for me to proceed and for your docs to be processed for closing. Photo ID must be current. Some lenders will not accept an expired DL/passport.
4) Please have a cashier's chec for $xxx. Amounts over $1500 must be in the form of a wire or cashier's check.
5) You'll have to check with your loan officer on the exact date of closing.
6) Taxes will be prorated and collected in advance now since tax bills are just being sent out, and insurance premiums are collected for a year in advance to fund the loan, lenders requirements.
7) Prior to funding conditions may require the notary to provide a copy of bond and E&O policies.
8) Is there a security gate at your property and how do I contact you at the gate? A couple of appts I had last week, six dogs met me at the gate and there was no controller to press a code or call button. The borrowers had to come out and manually open the gate.

How much did I want to get out of my car~not at all~

Boy, has this business accelerated in notary's expertise and details and duties to close. Any one else care to contribute to this list of preamble to attending the signing appointment?

Pulling my hair out...couldn't stay signed in, kept timing out. The borrower was getting hot under the collar, he had a dinner appointment he was 45 minutes late for...At one point, he threatened to file a lawsuit because he would be losing his rate if we didn't get this thing signed. It was 8pm at night....

Any one else have issues with this vendor?

What a way to top out of a 10-package signing day....I went home and watched the lightning storm for an hour with a glass of merlot and hit the hay absolutely exhausted. Glad most of my clients are nice people.

I can't wait for cooler weather! It's been in the 90s. Were even hearing about showers in north county. However, with the threat of thunder/lightning, we could have some brush fires...

More on $60 for notary fees, there were only three documents, two signatures requiring notarization. In CA it is the law that title/escrow charge for notary fees. I didn't feel any explanation was due this borish man. He was so unsavory, I didn't feel like qualifying my position there. He was too volatile.

Speaking of volatile men, yesterday we had a man show up at our title office, ranting and raving, he was in his 70s, 8 ladies rushed to find out how we could diffuse his anger and disruption. Finally we discovered that he wasn't even in the right title office.

It was kind of fun to watch him pull his tail between his legs and leave the building. NO APOLOGIES, we were just happy to be rid of him.

4.09% interest rates for 30 year fixed the lowest since 1951. Shore up! It's going to be a wild ride the rest of the year! HAPPY END OF MONTH...heading out now for a rock an roll day!
 
 
Notary "Fee" Gouging, says one borrower

Did a Chase refi on a commercial apartment building...Borrowers are very well to do.

He looks at the closing statement sees $60 for notary fees and begins yelling. You people are gouging me for all these fees. I let him go off, I had no retort, what could I say, sitting at the long mahogany table in board of directors conference room. I had to bite my tongue. I had no response. I just listened to him bellyache, he was very cross. I said, well, let's move this along, I have another appt in 45 minutes, I don't want to have to adjourn his signing to attend the next one. By the way, he was 15 minutes late.

He told me he can get a notary any ole time to do it for nothing. I had no response, I was obviously dealing with someone who feels he is way more important than the rest of the worldly people on this planet.

ho-hum...I was certainly happy to meet the next client who was delighted with his loan and who regards the talents and expertise of title and escrow in a fast and furious refi market we're experiencing this season.
 
 
Staying Alive in a Frenzy

Well, it was a loooonnnngggg day. I turned away as much work as I completed. It was a rock and roll day, and everyone was on time...what a blessing. Some days are way better than others.

Having a nice fish and veggie dinner with Bro who continues to get stronger every day following his heart surgery...my sister is spoiling him with fabulous homestyle cooking...low fat, no dairy, fish and veggie regime.

I could get behind this myself. I have a spillover from today into tomorrow, then I'm going to walk around my yard with a cup of coffee and pruners and sing to myself...ready for some downtime.

Mr. Beserk sent me some flowers~

I get to a signing this week when I'm standing on my head and very tightly scheduled. Borrower asks me to meet him at his office, a huge Blue Chip stock company. I sign in and get a visitors badge. The receptionist is trying to page and call him, I let her know he called to say he was at the bank.

Meanwhile, his well intended EA comes out to tell me he's in China, and I say, no, I just spoke with him, he's on his way and we have an appt.

He comes sauntering in 30 minutes later wearing shorts and sandals, he's the VP of International Business Develpment, way more important than any one else on the planet, the docs are three inches high. He's on the phone discussing the pros and cons of Droid Vs. Iphone. My blood pressure is soaring. I finally say, "we'll have to reschedule, because I have another appt in 30 minutes, he's very late, and I'm pretty sure he's not ready to sign." He starts yelling that we have to sign, he's suffering sleep deprivation/jet lag and in a bad mood. MARVELOUS. Well, I get him signed in 15 minutes while he calls his loan officer to say the cash out is wrong, they are paying off his Audi and he doesn't want that. Rate lock expires Monday. All kinds of drama. My head was spinning. I still had 6 more appointments, it's like the domino effect, everyone is late for the rest of the day, I'll spend the day apologizing and explaining why I'm running late.

Don't you just love it, and he didn't go to the bank to get a cashier's check for the closing, just decided to go to the bank for cash. Crazy...it all worked out, I got these out in FEDEX same day....miracles happen every day.

I think every borrower thinks they are the only ones signing their docs that day! So gotta get out my cue card that says "You're no. 6 of 12 signings I have today, can you please make sure you can make the appt on time and have copies of your drivers license, do you have a dog in the yard, yada yada."

 
 
Notary Story

I performed a refinance loan signing accommodation or a very prominent pulmonary physician here in Santa Barbara this seek. Mrs. told me that four years ago when they refi'd, shortly thereafter they received a call from the Postmaster in town that a flash drive had been turned into him by a customer who found it in the parking lot.

The Postmaster plugged it in and discovered a large file of documents which were the Borrowers loan file, and he found their phone number on the 1003 and placed a call to them. The Postmaster personally delivered the drive to their home.

I explained to the borrower it would seem this notary did not have a printer at home and downloaded their file to this flash drive, probably took it to their office or to Kinko's or who knows where to print out the documents for the assignment.

Well, every hair on my body stood straight up on end, and I was in disbelief that they didn't take action. They were just relieved that the drive was found by a good honest person and turned it in to someone of repute without divulging their information.

I wonder if this notary is still in business. I'll be researching it. This my friends is my competition. Pretty sloppy work.

I just returned from a long weekend in Glenwood Springs, CO and we had a wonderful time. What a beautiful place. I am getting caught up this morning, in spite of catching a bit of a cold, and was reading some prior post threads.

The only way to make it in this business is to keep the power of the positive thought. It seems like some posts are opportunities to rant and rave, but for the most part the contribution here over and over has helped me in this business to stay on the cutting edge. The lending market is always going to be here. There is a lot of opportunity if we can stay positive and learn new ways of doing this business, who to work for and who not to work for.

(BTW, my brother is home from recuperating and doing great. What a blessing Ted is still here. Our mom brought the AMTRAK down from Oregon to be with him for a few weeks.)
 
 
Driver Needed from Las Vegas, NV to Ventura, CA

I'm looking for someone to transport an individual to bring my brother from Las Vegas to Ventura today, I'm looking for someone highly competent with good, A/C equipped transportation, a comfortable ride (no harley's please). Compensation is negotiable. I'm not putting this on Craigslist because it's a crap shoot screening people's qualifications. I've often thought of starting a limo servicde here in the wine country.

I know this community is a trustworthy one and hence I'm posting here. Individual must be insured and have a clean driving record. It's a five-hour drive each way. My brother Ted is able to come home today, and his daughter's car (she's there now) has no A/C. It's been 100 in Las Vegas this week.

Disaster Signing Job on two-part signing

I accepted overnight docs for the second of two-part signing for Friday evening. It was a refinance, the parents in Orange county signed with a notary there. Unbelievable, I started going through the docs and discovered:

Parents did not sign the 1003, first page at the top, the 4506T which is a deal breaker for a timely closing, nor did they sign letters of explanation required in prior to funding conditions.

As I began to carefully review the documents yesterday before dropping at FEDEX, I discovered that the first notary failed to cross out my signers name on the acknowledgments and jurats, since he was not present at the signing. Nor did he bother to cross out his/her, etc. and make it their/they in the instruments.

It's probaby one of the most negligent signings I've witnessed in my career. The guy is listed in this forum as a regular member with no comments in his profile. I just wonder how the heck does someone with no proficiency get work. Must be related to someone at the schedulers office.

If this is any example of our competition, then we have nothing to worry about. I made a list of omissions on a sheet of paper and sent off the package, as well as to give the closing team a heads up in an email so that they can get the 4506T, 1003 and LOEs signed early in the day and not hold up getting the documents back to the lender for final review before funding.

I'm off to the airport to head for Las Vegas to see my brother Ted, who is progressing nicely. I think we're doing great in recovery although he's on a lot of meds. He's walking around, had all his tubes removed and eating, low sodium low carbohydrate diet. I will take his daughter, my niece out for a nice dinner, she's been a trooper staying by his side since before the surgery. She has four children at home. I think Ted will be home by Wednesday at the latest.

Rude Competition

Yesterday I was at a bank branch signing a couple for their refi. The loan officer couldn't be there because he had to attend another signing at a nearby branch. He asked if I might be able to come over and complete the signing because the notary who attended that closing was rude and arrogant and a biotch to the borrowers. WTH is up with that?

Can you imagine how a notary could think this is appropriate? Need less to say, that notary will be banned from that bank's signings going forward. I don't get it. Well, competition, you've just made it possible for me to be the go-to notary for that loan officer.

Two more days and this craziness will slow down a bit. Doing a lot of 10, 15 and 20 year refi's right now, a few REO purchases. Interest rates at an all time low have made a significant surge in this area right now.

Ted is recovering nicely in CCU and I'm leaving Friday night to go spend the weekend with him. One of my signings yesterday was for a couple who work in the cardio department of Cottage Hospital, and they were very supportive and informative about Ted's recovery from triple bypass yesterday...I relaxed a little.

My original message is buried below. Wanted to thank you all for your prayers and compassion. My brother is one of those one in a million guys...Sweet, always generous with his time and helping me at the vineyard. His surgery is this morning at 10. His kids are with him, Ginger and Randall, from Bishop, CA. My sister is flying out this morning for a couple of days, I'll be there over the weekend.

Thanks again, and Hugh, love your levity, it takes the bite out a little bit. I'm going to cut and paste your remarks and email to Ted. Hope to get a laugh, he's pretty upset and on edge right now. Ted loves the Lord, this will carry all of us through this stressful event. I'm very happy Ted didn't have a fatal heart attack...just a little tap on the shoulder, hey, take better care of yourself now.

My 54 year old "baby" brother is on his way from Laughlin, NV to Las Vegas Hospital via ambulance for a triple bypass very shortly. Surgery at 8am. I know these are pretty routine procedures these days. None the less, I know the power of greatness in prayers from this board and I ask that you put out your fervent prayers for Ted Warren Wilson's surgery to go well and successfully. He and my sister were vacationing when Ted began having chest pains and went to a local hospital. He is my favorite brother, his daughter is with him for the ride.

No additions to the GFE can be made without the lender giving borrowers' advance notice and approval (full disclosure). I've been noticing that some lenders/escrow companies are attempting to slip cost line items in at the 13th hour, especially during the hustle and bustle of mid month and month end chaos to close files in a timely manner.
 
 
HUD Loan Packages

I did the first HUD loan I've signed in years for a couple on Friday. it was a whopping 185 pages with lots of redundancy, and 33 pages from escrow. Then a copy for the borrower. They had been in the process for six months, took a class on how to apply for HUD financing with little money down. They were first time buyers too.

It took over an hour to go through the package and to double check the entire package before shipping it out. I did not get enough money for this assignment, I was so busy last week that i failed to ask how big the file was prior to agreeing to the fee.

You know the drill, you can't go back and ask for more once you've accepted the job. Shame on me for not practicing what I preach. Since there are bound to be more of these coming down the pike, just a reminder to everyone it's wise to find out if it's going to be a fast WF file or a broker originated loan which always has lots of redundant documents and disclosures, affidavits and 1003s.



Okay, well, I'm done ranting, going out to water my grapes and plant a few new vines before it gets too hot to be out there.

 
 
NR Kudos for Fast Efficient Service

This past week I was asked to perform a notary with a gold seal embossment of a document going to a foreign country.

I haven't had an embosser for years, but since I've had a couple requests lately for this, I decided to order one. I did a little shopping around and found that although NR is in Des Moines, they offer the fastest service of all suppliers I contacted. I placed the order on Thursday, got my SOS certificate to authorize the mfr of this embosser and a new commission stamp overnighted, and it will be delivered on Tuesday next week.

Not bad. The other big supplier in CA said it would take five days to make up the embosser, then shipping time. Clearly not on the same level of service as NR, and they are just down the road from me! WTH!
