Apologies if some feel this doesn't belong in notary work. But I feel that, even with this being related to Kazakhstan, what with the prior discussions on what states charge, and what is allowed, and the low-balling company, this might, for some, put a slightly different perspective on fees.

Dayton OH owner of 3 title companies pleads guilty

The loans, involving residential properties, were filed with lending institutions across the nation.

Hillard OH title/mortgany companies owners, workers indicted

Named in FEDERAL grand jury indictments were the owner and husband of Coast to Coast Title and Premiere Title, both based out of Hillard, Ohio. Also named was an employee who closed loans for Premiere Title and an employee of Platinum Mortgage, who allegedly arranged loans for the owner and employee of Premiere Title.

The only good thing, if you can call it that, was that according to the article these were investment properties and not residential properties. The link is from an NBC affiliate based out of Columbus.

Signing with conflicting instructions

What do you do when the instructions from the signing service conflict with the directions from the lender that are enclosed with the docs?

The opportunity came up for a notarization about 3 miles from my house. Never worked with the signing service before, so have no point of reference. There were mixed comments in SC, and because this was so close I thought I would give it a try.

The problem? After downloading the docs, the directions enclosed from the lender are in conflict with and contradict what the signing service is saying in emails specific to the signing. For example, SS is saying only one POA while lender's paperwork is saying two originals are needed. I'm planning a phone call to ss shortly to see what they say about this.

It is with sadness I read this article. What was this person thinking; was it worth it? As the article mentioned, this also came out of the Nevada AGs probe into robo signing that resulted in over 200 charges brought against two other individuals (see post below) "A notary public in Clark County has pleaded guilty to one count of fraud for notarizing the signature of a person not in her presence."

Title company over forged signatures (Illinois)

"A title insurance company was forced to pay a man more than $90,000 after a woman fraudulently signed the man's name to papers, in effect deeding his property to another person without his knowledge or consent, according to a recently filed lawsuit.

Ticor Title Insurance Company filed a lawsuit Nov. 7 in St. Clair County Circuit Court against Yvette Reed, Diane Lee, Joseph Reed, Alfredo Vallejo Jr., RLI Corp., CNA Surety and All-American Escrow and Title Services.

In its complaint, Ticor alleges it paid Joe Lee $90,000 after he filed a lawsuit against the company. Joe Lee brought the suit against Ticor after he discovered that his interest in property at 4645 South Lamon Ave. in Chicago had been taken from him, according to the current complaint."

Class action lawsuit filed against MERS in Michigan

Register of Deeds in two counties (Ingham and Branch) filed the lawsuit on behalf of all of the 83 counties in Michigan.

"Curtis Hertel, Jr., the Ingham County Register of Deeds, and Branch County Registrar Nancy Hutchins filed the suit, which alleges that the company and numerous banks failed to pay property transfer taxes when the title to the company was transferred to another owner in the MERS system. "

Another viewpoint/discussion on docs on CD

I know both pro and cons of copies on CD has been discussed here before, but those discussions usually centered on the notary putting copies on CDs. The following question was posed in a real estate forum by the borrower. The general tone of the answer in the forum was to notify the title agency involved, both local and national offices. And check your credit. The response continued with advice that the borrower had no way to tell if this was an isolated incident, and to continue with other potential actions against the title would be a judgement call on the part of the borrower.

Here is my question to other notaries (and I think I know the responses already). If, while sitting at the table, you found out that from borrower received a CD with documents for a total stranger instead of their information, would you do anything else other strongly recommend that borrower contact the Title office?

In case anyone works with petitions or elections . . . not that that is the only resource where neatness and attention to detail are needed:

"Of the 58 deemed invalid, 10 were because a notary public was unidentifiable by signature and the town was incorrectly listed as "Town of NH," six because a notary public wrote an illegible date ("The month appears to be August, but could be June or July"), one due to an altered date without initials, one due to a printed name, and one due to printed name and illegible date, according to court documents."

Nationality Requirement Not Applicable to Notaries

EU member states may not ban foreigners from working as notaries, the European Court of Justice has ruled in response to cases opened by the European Commission against seven member states, Belgium, France, Luxembourg, Austria, Germany, Greece, and Portugal. According to the Commission, these countries infringed upon EU regulations by allowing only their own nationals to work as notaries.

In order to make a judgment, the European Court of Justice first needed to decide whether notaries exercised official authority, as the exercise of official authority is exempt from the principle of “freedom of establishment”—the right to work self-employed and to set up a company—provided for by the Treaty on the European Community.

According to the European Court of Justice, responsibilities handled by notaries are not a case of exercising official authority. Furthermore, unlike public authorities, notaries compete with one another and are directly and personally liable for any damage done to their clients.

The judgment of the European Court of Justice also applies to Poland because the European Commission has challenged Polish regulations on the nationality requirement for those appointed to work as notaries. The Commission plans to refer the case to the European Court of Justice.

No I'm not making this up. And yes, this is the actual ad, with email and phone altered to protect the poor soul who is looking for a notary. BTW, isn't $10 the max you can charge in California?

Vignature - not online notarizations but verifying signature

From what I'm reading, this is a use of electronic signatures and transmitting documents electronically using PDF formats. No mention is made of notarizations using online cameras, although the article does state--when using electronics processes such as this--the questions become 1) is the process secure and 2) is the person who is signing who they say they are.

I know there is a process where identities are confirmed but the signatures aren't notarized (I think this is the TEA certification from the NNA), but I also think that some of the general public may start referring to or thinking what Vignature does as notarizations. It's not. And that may start a whole new set of problems for notaries.

I welcome your opinions.
