The Commercial Collection Agency Association (http:/www.ccaacollect.com) has some pretty good info about collections available for free. I also found a link to a summary of state bad check laws available at:

Note that this is a link to a PDF file, and doesn't appear on their website. The summary is 3 years old, so some info may be outdated.
I found this while skimming through the summary:
"It is generally held that the giving of a bad check in payment of a preexisting debt does not fall within the purview of most states' bad check laws. Since the debt is preexisting the maker of the check did not deprive the payee of any right, procure anything of value from the payee or wrongfully appropriate anything belonging to the payee."
If I'm reading that correctly, tendering an NSF check for a C.O.D. would fall under the law, but paying an invoice with an NSF check would not.

The initial question is not about the the same situation we would be in, but the article addresses independent contractors in general and lays out in simple terms what you need to do to try to collect some of what is owed to you. There's a phone number included, but that's for the Bankruptcy Court here on Long Island - I imagine the rules are the same everywhere else since it's a Federal court, but you'll have to find the court that covers your district.
Pay particular attention to the part at the end where she talks about maybe having to give back any payments you received if they were made just before the firm declared bankruptcy - that's a nasty surprise....

I know they buried the real amount somewhere else, and much of the time that line is blank, but if there's an amount there I've never seen it less than what I'm being paid. Anyone else run into this before? |

About 6500 being laid off, 1300 of those here on Long Island where AHM is (was?) headquartered. Employees here were given one day's notice, and it's unclear whether they will be paid. Mortgages in the pipeline that were approved will not be funded, leaving borrowers to scramble and find another lender.
This was not a sub-prime lender, but the fallout from that meltdown is starting to roll up the food chain. Buckle up, guys - this is going to be a wild ride before it's over... |

They are lheadquarterd here on Long Island, NY - I have friends who work there and some got caught up in a recent round of layoffs, and that was before things really got nasty. AHM is the 6th largest company on LI, and one of the major residential mortgage companies nationally. Stock was trading at $1.04 at close of market today... ouch. |

Posted by MikeC/NY at 7/6/2007 10:46:00 PM | If you're at all interested in the topic, I highly recommend the documentary "Maxed Out", which is now available on DVD (got mine through Netflix, I'm sure Blockbuster has it also). It mostly focuses on credit card debt, with a little bit about predatory lending - it's a very sobering look at the credit industry, and helps explain some of the wacky loans we see.
There are some segments with a definite political agenda. If you ignore those, I think it's well done and a definite eye-opener... |
| | | | | Head up on loose certificates Posted by MikeC/NY at 6/23/2007 1:38:00 PM | I just had a TC tell me that the loose acknowledgment certificate I attached to a Florida mortgage would not be acceptable in Dade County because of the paper size - it has to be on the same size paper as the mortgage. I've been using loose certificates I bought from the NNA, which measure 8-1/2 x 7, and this is the first time anyone has questioned the size of these pages.
PAW tells me that this will eventually be the case in all Florida counties, because of scanning requirements in the county clerk's offices. It's not unlikely that other states may start doing the same as their technology for recording documents changes. Unfortunately, no one sends up a balloon when these changes in requirements occur. I don't understand why the certs are sold on odd-size paper in the first place, but that's an argument for another day...
Rather than have to deal with this again, I decided to start printing and carrying loose certificates on both letter and legal size paper, and will match the certificate size to the document. It might be overkill, but it's better than having to do a re-sign because the acknowledgment was rejected.
He also mentioned that FL counties might start requiring mortgages and DOTs to be on letter-size paper only. This hasn't happened yet, but it's something to watch out for because when and if it does happen, it may have an impact on SAs who don't have dual-tray printers...
