In Oregon, the witness must be personally known to ~both~ the signer and the Notary. Very rare. A casual business relationship with the signer (say, a RE agent for property purchase,) or a caregiver in a professional capacity (i.e., nurse/attendant) do not qualify under the riggors of "Personal knowledge."
Many states are eliminating the Credible Witness avenue of identification altogether.
I'd be interested in hearing the definitions of CW in other states, and, learn which states do/not allow CWs for IDing. |

I've been researching for months, doing the online configurations, and reading reveiws. Just curious if anyone in the community has tried them, found problems, and hated the experience - or - tried, found no problems, and loved the outcome. For you real estate folks, do built-in closet systems add any appreciable value to a sales price? (I know, I know, "It depends..." <feeble grin>
One project is a present for Dad, as his closet is so stuffed, he can't even walk-in anymore, and I thought this would be a great incentive to tackle a huge job that he would just as soon ignore. But, even after he has so graciously accepted the 'change,' I'm still having a hard time clicking that 'check out' button...
Another system I like is the John Louis Home wood systems. You have to put them together, cutting to fit, and such, but no melamine. On the other hand, the side panels are louvered, so there's the dusting issue.
Sigh. Any insights would help at this point.

As more companies embrace these clarifications, and they clearly are, those who opt for participation in the processes of finalizing the language by submitting comments, will have a far greater impact on the sensibilities of the final product as it relates to our particular niche in the closing process than those who cling so tenatiously to the withering status quo. |

Posted by Susan Fischer at 12/5/2007 12:49:00 AM | (The power was such a joy to come home to after a lengthy signing at a tiny restaurant table - while Mr and Mrs had lunch, leisurely telling stories, and dashing off signatures every once in a while. Over 12,000 of us were (and some still are) without power, and the radio station was again our lifeline.)
And the folks from Tillamook to Astoria are hard hit - battling the slowly subsiding Trask and Wilson rivers. FEMA has proven fairly heartless in the past, according to many borrowers' astonishing stories.
But the wildlife went, well, wild. You know It's Here when the seagulls are flying backwards. And as the wind escalated in longer and stronger gusts, even those big, strong birds finally had to give it up and head for cover.
By Monday, the Pacific was a 40-foot sea, measured from the bottom of a trough to the top of the crest, and all you could see was furiouswater, crashing and hurling at you from the rising horizon.
The Clipper Ship Coffee Shop had their usual (delicious) camp coffee drive-thru, and Sambo's just last month installed a generator system, and its welcoming Christmas lights were the only color along the highway. Roger's radio station, KBCH, lost transmission, but KYTE put him on the air because Roger understands the function of local radio; and admonished the clueless, speed-talking DeeJay that right now, "is not about the music, it's about the people and the human voice - a voice with news and information." We all said an Amen.
It was a big blow to miss the webconference, so I need to print off the powerpont, and catch up.
Since the fiber optic cable was severed over in Sheriden, the phones were toast. No cells anywhere until about 2 PM Sun, and that was Cingular (yay for me this time around), so several folks in town brought their cells to KBCH so people could come to the station and call out to freinds and love ones (no Santa lists, just news). Meals on Wheels was down, so Roger got that group effort started, and, well, the stories go on. As I said last storm, Lincoln City may not have electricity, but we've got power.
I digress. While waiting for Roger's next report, I noticed four intrepid little Coots, small black ducks with a pinch of white on their heads, surfing the foot-tall waves of the lake, their little webbed feet paddling madly up one side, disappearing momentarily to slide down the other - upupup up, wheee! all day long. Every once in a while they'd dive, like sinking stones, for a nibble, then pop up to climb another whitecap. Wildlife teenagers?
On Monday, with the wind gusting like punches, out my window a lichen clung with its hairy fingers to the sleeping, writhing limbs; its sage green a glorious color in the gray afternoon. It's done, no single leaf left to admit victory over Autumn's letting-go. Not one single remnant of busy Spring.
It's so quiet tonight. |

Begging a notary to backdate because, "...to tell you the truth, the other notary screwed up and won't be available until Saturday, and now we look bad to our client and need to get this handled" (or insert similar feeble excuse) - still completely floors me.
I'd love to post their name...would it do any good?

My two recommended book arived this week, plus, there's another must-read by Brenda TX on RMs.
Recent threads have discussed marketing and the position of the NSA in in Industry. One of our own has written a gift of marketing savvy, and contributed mightily to the presence of our speciality in the Industry.
Like everything valuable, it comes with a price. This book is cheap at twice the price. The business oriented folks will be pleasantly surprised at the ease of explanation, simplicity of design, and abundance of rewarding advice.
Laura, thank you eversomuch. You have put so much effort into the furthering of our profession, and, your style can't be beat!

Can a Notary Signing Agent collect funds (in this case, $3600) from a borrower, where there is neither 'cash/check' due from borrower on the HUD-1, nor that amount evidenced on any document in the packet, but where the "Loan Officer" alone is demanding the funds?
This question arises in the wake of a contentious signing that the borrower untimately refused to complete. [During the signing, the borrower was in lengthy contact with the LO, who could not convince her to accept this deal. The LO had directed the borrower to have the cashier's checks (the first for $3200 and an additional check for $400) made out to the Title Company (Settlement Agent).] Question # 2:
Under what circumstances is the amount in the "Amount Financed" box of the Truth in Lending form lower than the "Principal" on the Note, and the "Amount Borrowed" on the HUD-1? Does it have to do with ARMs?
(For my own edification and not related to the prior question.)

Also, looking for another cable connection - Dish is advertising hard. Seems I remember a 'contract' time limit some time ago - like cell phone providers, a year or two. Maybe there are other options, I need to check. I dislike the whole 'contract' for payment-certain concept for open market services.
