Maria: Hi Hugh.
Hugh Nations: Hello, Maria. Are you sure this isn't Peggy?
Maria: Please give me a moment while I check that for you.
Maria: Thank you for your patience. I am sorry we do not have the information about Peggy
Hugh Nations: Maria, that is a joke. Peggy, in Uzbeckistan, from the TV commercials for Discover?
Maria: May I have the order# where you misplaced the coupon.
Hugh Nations: I don't know what you mean by the order #. Every quarter, I get a coupon for credits I have earned on my Worklife Rewards program. I received the coupon, put it in my wallet, and when I went to use it, it was no longer there. There was no order associated with it.
Maria: I am sorry, due to security reasons we do not have the information for rewards account in on line, We do have separate department for it so I request you to contact Worklife Rewards department @ 1-866-322-3225 they will send the new card to your location.
Hugh Nations: Thanks, I'll do that. You've been most helpful. You and Peggy have a wonderful week.
Maria: As I said, we don’t have any information about Peggy.

| | | | | I've spent most of my adult life... Posted by HisHughness at 1/16/2012 9:04:00 AM | ...and many of my younger years, focusing on words: Their meanings, their spellings, their origins, their emotional impact, how they fit together, how to use them properly. Because of that, sometimes I have a lamentable tendency to judge the inherent worth of others by the words they use and how they use them. It is a form of snobbery that is unbecoming and says more about the person who employs it than it does about the target.
Martin Luther King said it well: "Everybody can be great because anybody can serve. You don’t have to have a college degree to serve. You don’t have to make your subject and verbs agree to serve. You only need a heart full of grace, a soul generated by love.”
So, today, on MLK Day, let me extend my apologies to anyone on this forum that I have used my passion for words to offend. There have been, I fear, far too many. I will try to do better. And for those who chose to overlook my transgressions, and accord me the respect that I denied you, thank you for your generosity of spirit.

| | | | | How far should a notary go... Posted by HisHughness at 1/16/2012 8:40:00 AM | | ...in ascertaining whether a witness to a signature has no vested interest in the transaction? If, for example, both signer and witness say there is no vested interest, but the notary suspects there is, and has explained the ramifications, is that sufficient? Does the notary have ANY responsibility to vet the witness other than explaining that a disinterested witness is required? What if the notary has detected no hint of a fraudulent transaction, but the signer and witness simply are acting out of convenience? |
| | | | | For those of you who distribute promotional items Posted by HisHughness at 1/15/2012 9:27:00 PM | I have, over the years, given away everything from keychain calculators to notepads with pen attached to refrigerator magnets to laser pointer pens to microwave ovens. (Well...okay, the microwave is a stretch, but I've given away some really hot items.) Far and away the best response I have gotten has been a pen sold by National Pen Co. Rolled up inside the barrel of the pen like a windowshade is a pullout calendar. On one side it has 2012, the other has 2013.
Thing is, National Pen has stocks of unsold pens with 2011 & 2012 calendars. They are selling the pens at 29 each, regardless of volume; normally, I think they sell for about $1.29. It is a good deal that won't last long, and I would highly recommend anyone seeking an effective promo item jump on it now. Shipping is about $15, and there is no setup fee for this sale. The pens carry four llines of imprint, so you could darn near write your autobiography on them.
Remember, they'll be gone shortly at that price, so you need to act quickly.
Went back and read this post after I was finshed with it, and it got me to wondering: Does anybody under 40 even know what a windowshade is, and how it operates? |
| | | | | Why this forum is so much fun Posted by HisHughness at 1/14/2012 9:51:00 AM | It's all a matter of perspective.
The glass half full -- Message #409019 Discuss Work: I really enjoy reading your posts. They have such humor and are so ridiculously "smart" and never with ill-intent...
The glass half empty -- Message #408885 Discuss Work: You cannot help yourself nor control yourself. You are a bully - yep, a BULLY. Not that sweet, funny old man.
The glass empty, bone dry, cracked and tossed out with all the rest of the trash -- Message #45720 JPol: ...some poor deluded ex-scrivener sitting in a corner posting his heart out to a miniscule audience desperately trying for, and saying anything to gain some attention. |
| | | | | I know this has been discussed before... Posted by HisHughness at 1/13/2012 4:59:00 PM | ...but perhaps not from this perspective. At least, I don't remember it if it has (Which is not much of a guarantee of anything, since I have ex-wives whose names I can't recall.)
Is there any functional reason which dictates that the closing packet is the best way to send the closing instructions to the escrow officer, or even a good way to send them? I'd really like to hear from some former escrow officers on this, since I've never worked at a McTitle operation -- or any kind of title operation. Does including them in the borrowers' packet make any sense at all? |

| | | | | Request to other members of the forum Posted by HisHughness at 1/12/2012 2:35:00 PM | The preceding thread contains a post which is political. The rules of the forum are quite clear: "avoid topics that others may consider offensive, such as politics..."
Uniformly, such posts that violate the rules of the forum have been made by conservative/Republican posters. In the past, when responding, I have always pointed out that only the conservatives think they have the right to break the rules. The post below follows the same pattern: The poster is well aware that what he is doing is not permitted, but chooses to ignore the rule that others follow.
The last time one of these posts surfaced in Discuss Work, I resolved that I would simply note that it was inappropriate and then I would report it. That's what I did in the post below. I would like to urge other participants in the Discuss Work forum who enjoy the extra dimension it brings to our working life to do the same.
There is a forum on NotRot devoted solely to politics: It is Just Politics, and it was created specifically to remove from Discuss Work the hostilities and animosities that so often accompany political discussions. Those hostilities and animosities run rampant on JPol, and I don't think any responsible, rational participant on <this> forum want them contaminating it.
So, you don't have to respond to any political post. You don't have to agree with it, or disagree with it. You don't have to respond saying it was inappropriate. If you want to see <this> forum continue to be devoted to talking about our work, rather than yelling at each other about how much we hate the president or what a sorry lot the Republican presidential hopefuls are, all you have to do is hit the report button to say that the post is political.
That's what I'll be doing in the future. And thanks to all who act to help keep this forum useful. |

Posted by HisHughness at 1/5/2012 6:09:00 PM | ...just shipped by Amazon, and they're using something called Ensenda that I haven't ever encountered before. I gather it is some sort of overarching software program that is adopted by local delivery companies who otherwise remain independent.
Has anybody eles run across this company, and how does it work? Do you know if an individual can ship through them? The name sounds like either a laxative or an aphrodisiac or, heaven forbid, a combination of the two. |
| | | | | Returning to the subject of a new GPS Posted by HisHughness at 12/31/2011 6:21:00 PM | I have settled on a Garmin Nuvi 1490 with Bluetooth and lifetime maps and traffic. Amazon has a good price on one, and (this may be good news for those who don't know they are available), there is an inexpensive mount that fits in the cup holder. Input would be appreciated.
On another technofront, I may be coming to an accomodation with 21st Century technology. This morning, I listened to the audio of NCIS on my new 32-inch flatscreen LG HDTV through headphones while I was brushing my teeth. Wonderful experience. Can't wait to try that in the shower. |
| | | | | I am a dedicated technophobe. Posted by HisHughness at 12/28/2011 9:14:00 PM | My computer runs on kerosene. The nail on my index finger is kept clipped short so that it doesn't get hung up in my rotary dial phone. The last computer game I played was Pong, and that substantially exceeded my grasp of technology. Frogger screwed up my synapses so badly I was the subject of several medical journal treatises.
Nonetheless, I find that the tech world has caught up with me, run me down, hogtied me, and is ready to dump me into whatever universe is inhabited by you people who actually understand what the term analog means.
My Magellan GPS has had a nervous breakdown, which I think is only fitting considering the number of times it has had me hyperventillating. I have to get a new GPS. This is a prospect I confront with much trepidation. For Christmas I gave myself a new HDTV to replace the cathode ray tube set on which I had watched the moon landings. Not the ones you are thinking of: I'm talking about those recounted in the 1958 film version of Jules Verne's "From the Earth to the Moon." I had planned to spend 2012 learning how to operate the TV. Now it looks like I will have two electronic devices to bedevil me simultaneously, one while trying to ignore other drivers yelling about Olde Phartz behind the wheel.
I would appreciate some help from those of you who actually know what an iPhone app is. I'd like to know what I should take pains to avoid in a GPS, and what amenities are most useful. I do want free map updates, and since PeeBee the Platinum Blonde is no longer around to provide backseat driving guidance, a sultry female voice would be welcome. I probably should also also point out that I am an extraordinarily cheap technophobe.

| | | | | I just sent off this email to TranStar Posted by HisHughness at 12/21/2011 10:00:00 PM | In reviewing their ratings on Signing Central, they were just so exceptional, I felt almost compelled to commend them on their contribution to our profession.
"I just finished a closing for you folks. You paid me within 9 days, an exception even by title companies nowadays. But that's not what I wanted to commend you for.
"Out of curiosity, I went to Signing Central on Notary Rotary to review comments by other signing agents. Of 77 who rated your company, 75 -- that's 97.4 percent -- rated you with 4 or 5 stars. Only one gave you a 2-star rating, and only one gave you a 3-star rating. In fact, going back four years, you have obtained a 5-star rating from 80.5 percent of those who rated you.
"That is truly exceptional, and I want you to know that the signing agent community appreciates that kind of responsible performance. Thank you.
"You don't need to respond to this. I just wanted you to know that the good guys are indeed appreciated."

| | | | | Niggling question Posted by HisHughness at 12/16/2011 1:12:00 AM | Often we encounter affidavits in which the venue is listed at the very top of the affidavit, and venue will likewise be listed on the notarial certification also. If the subject property is outside the county of the notarization, what venue is used in the heading of the affidavit in such cases?
An affiliated question relates to corrections. Such affidavits often are framed to include the officer notarizing the affidavit. In such instances, when a correction is necessary in the body of the affidavit, who initials the correction -- the borrower(s) and the notary, or just one or the other, and, if so, which one?
Please: If you answer and if you have authority for your answer, cite your authority. If your answer is based solely on your opinion or experience, stipulate that. I think that might reduce the heat during the discussion.
I know that this question was dealt with tangentially in an earlier thread, but I don't think it was answered definitively. |

| | | | | Signing Central has its limitations Posted by HisHughness at 11/29/2011 3:05:00 PM | Or, perhaps more correctly, it doesn't take into account MY limitations.
Accepted a closing from Expert Signings. Checked SC, everything hunky dory. Got screwed, went back to SC. Seems there is an Expert Signing Service, which has an excellent reputation, and then there is Expert Signings, which -- you guessed it -- is not even good enough to line the bottom of a bird cage.

| | | | | About this time of year, and into summer... Posted by HisHughness at 11/28/2011 9:06:00 PM | ...I start getting a lot of tax loans. They provide a substantial fraction of my revenue during that period.
I got my first one this afternoon, and turned one down Friday from a company I don't normally service, and in celebration went out to eat. A fancy new Indian restaurant -- you know, stemware, more forks than dishes to use them on, napkins so starchy you could hang them as wallboard -- has just opened up right down the expressway from me. So, I thought I would check it out, though I had never developed a taste for Indian food in the past. That, despite having had several fairly close Indian friends.
I'm now almost 75 years old, and I can finally say without reservation that I do not like Indian food. Thai, yes. Indonesian, yes. Ethiopian -- bring on the fried grasshoppers. But there will be no more forays to see if anything -- my tastebuds, the flavor of curry, strange smelling spices that are left over from curing saddle leather -- has changed about Indian food.
I can, though, offer one caution to anyone who has not yet reached my level of enlightenment about the subcontinent's cuisine, and who still insists upon trying it.
You will not retain the respect of any waiter from New Delhi if you request ketchup for your lamb shish kebab. |

| | | | | I am in desperate need of help Posted by HisHughness at 9/28/2011 8:20:00 PM | That, of course, is what my psychiatrist has been telling me for years.
Two weeks ago, I signed up for a program called Google Voice. I did so because I understood that by using it, any calls to my landline would also ring my cell phone. That did not turn out to be the case. The worst was yet to come, however.
Google sends all my messages to a Google voice mail program that I cannot access. As a consequence, I want to drop out of Google Voice. But if I understand what I am reading, having now signed up, I cannot quit. Let me say that again: I CANNOT QUIT. What I am reading says that dropping out is not now an option, but Google is working on it. Mind you, WORKING ON IT!
I have found no email address where I can confirm that, or get any assistance. I have found no phone number. I have found no physical address where I can toss a Molotov cocktail into Google's lobby..
I am, at this point, depending on where I am in the cycle of trying to find my way out of the Google Voice maze, irked, frustrated, irritated, angry, pissed off, really pissed off, enraged, or homicidal. There may come a time when I will simply give up and become suicidal.
Has anybody else signed up for this nonsense? Does anybody have any contact information for Google?
Please?

| | | | | Question for some of the more techno-savvy amongst us Posted by HisHughness at 9/24/2011 1:22:00 AM | Five percent of the traffic through my new blog is from Russia. All the rest is from the U.S., except for one lonely German.
I'm puzzled about the Russian interest. Had it been a one-time thing, I would have shrugged it off. But it is continuing. Is this some kind of spooky spiderbot crawling the web looking for paunchy punch-drunk lawyers to victimize? Even as inflated as my ego is, I am hard-pressed to believe that there are Russians just waiting to hang on my every printed word.
On the other hand, maybe I'd better go back and see if I really am that good. |

| | | | | A word of caution Posted by HisHughness at 9/6/2011 7:18:00 PM | This is a public forum, open to all, but this admonition applies to more private venues as well. You never know when those private conversations will become public, or just reach the wrong person.
You should be judicious in speaking of both other people and also of companies; in some jurisdictions, it is possible to libel or slander a corporation.
Generally speaking, the law and the First Amendment give you the right to your <opinion>, and the right to voice that opinion. I would feel fairly secure, for example, in saying, "I believe Bob_Chicago is an embarrassment not only to his mother, but even to second cousins he's never met." That is an opinion.
It is a greatly different thing, though, to state negative information as fact, as in"Bob_Chicago picks his nose and deposits the boogers in the upper-right-hand corner of his computer screen for later consumption." That is stating something as fact, and that can get you in trouble. Even if you aren't sued, you may be forced into a painful pubic apology, such as "I wish to apologize for stating that Bob_Chicago saves boogers for later consumption. That is not true. He prefers them warm." Or you may indeed be sued, and even if you prevail, you are out the expense of an attorney and the emotional trauma of a lawsuite.
Finally, remember that slander and libel are two different animals. Slander is basically what you say to someone else. Libel is something that is circulated in print -- as in this forum. Because the impact of libel is so much greater, generally it is regarded as a more serious offense with consequently greater damages.
Now, please, would none of you mention this post to Bob_Chicago? |

| | | | | A new one on me Posted by HisHughness at 8/29/2011 11:44:00 PM | Reverse mortgage signing Friday. Did all the notarizing. Entered everything in the journal. It’s EOM, so I’m pushed, but I double-checked; everything signed correctly. Got package off in time for delivery Monday. Something kept nagging at me, though. Finally, Sunday I pulled up the documents and looked at each one holistically – and I found it.
The Correction Agreement – Limited Power of Attorney named <me> as the AIF.
Emailed the title company. Was told that’s what they intended to do, in the event I needed to make corrections at the table. They were not at all concerned that I notarized a document in which I had a direct interest.
So, in attempting to cover their ass, they left mine totally bare, and still wound up with an invalid document.

| | | | | Geographically challenged scheduler Posted by HisHughness at 8/26/2011 5:17:00 AM | Me. Hi, Becky. I’m here on Bandera Road, and there is no 12,000 block.
Borrower. Huh?
Me. I’m on Bandera Road, and it’s only a four-block street, and it only goes up into the 4,000s.
Borrower. Where are you?
Me. I’m on Bandera Road, just off of Springdale and MLK.
Borrower. Huh?
Me. Can you tell me how to get to you?
Borrower. I’m on Bandera Road just outside Loop 1604.
Me: Okay, just outside…Wait a minute. Did you say Loop 1604?
Borrower. Yeah.
Me. Loop 1604 in San Antonio?
Borrower. Yeah.
Long pregnant pause. Pregnant pause gives birth to twins.
Me. I’m in Austin.
Twins’ mother emits, at full volume, a lexicography of salty language that would do any Bowery sailor proud.
The closing was rescheduled. The title company would do well not to let the scheduler for this closing handle any loans with a Main Street address. Considering how many cities share that name, no telling where the closing would end up.

| | | | | Query Posted by HisHughness at 8/8/2011 12:46:00 PM | I have a lender that is insisting that I provide new certifications because I struck from California acknowledgements that portion which subjects me to California perjury laws. I have told the lender I notarize in compliance with the laws of my jurisdiction, and California recorders are obligated to accept that. Texas law requires no such representation by a notary.
Thoughts?

| | | | | Quicken Loan closings Posted by HisHughness at 8/1/2011 4:38:00 PM | Recently I posted an account of a Quicken Loan refi closing on my daughter's home. I was impressed with the professionaism displayed by the loan officer, and were that the only criterion would unhesitatingly recommend Quicken.
However, if you recall, Title Source, which is the Quicken in-house TC, sent a signing agent to the closing who was so ill-prepared he did not even know how to swear a signer, and in fact did not know what a jurat is. There were other issues also.
Well, Title Source has informed me that they have now removed that NSA from their database. However, they have failed to address the fundamental problem, which is that only notaries of the caliber we got are going to be willing to accept their anemic fees.
Consequently, if you want to be assured that your closing will go smoothly and <that there will subsequently be no problems that could invalidate your closing documents>, I would definitely not recommend Quicken.
|
| | | | | Fee question Posted by HisHughness at 7/26/2011 8:46:00 PM | | Can somebody tell me what fees Title Source is offering when they call? Not the fee you charge them, but the fee the initially offer. Thanks. I'm sending an email to someone, so the soon I get the responses the better. |
| | | | | Can someone pleae explain the connection... Posted by HisHughness at 7/26/2011 1:52:00 PM | | .. between Quicken Loans and Title Source Inc.? Is TSI an in-house agency that serves only Quicken? |
| | | | | I finally learn how a $65 NSA performs Posted by HisHughness at 7/26/2011 12:10:00 AM | My daughter closed a Quicken refi on her house today. Loan went fine: LO was quite up front and competent, doc packet only 74 pages, lender paid all costs. I was impressed. Until the signing agent showed up. That was surreal.
He was 45 minutes and four “I’m lost” phone calls late. My daughter finally had to go collect him; she lives in an established, well-developed suburban area. Asked, he said he did indeed have a GPS, but his 19-year-old son has insisted on appropriating it because “he says he needs it more.” What does a cheap GPS cost on Amazon nowadays, $75-100?
He had my daughter fill out his journal, including her DL information. Under the document section, he told her to enter “mortgage.” Texas law requires that the NP record a description of every document he notarizes; for deeds, the information required is quite detailed. He recorded no individual documents, and, in answer to a query, indicated he did not know that recording in the journal is required.
He did not give my daughter any instructions at all pertaining to how to sign or initial documents. He did not explain any terms of, nor could he answer a simple question about the note. He offered no amplification on the Right To Cancel. He did not know what a jurat is; from the blank look, it was apparent he had never heard the term.
He swore her in only after I requested it halfway through the signing. It was obvious he had never sworn in another signer, because he did not know how to do it. After shuffling through many papers, he finally went to the oath that he had apparently taken as a notary public, which was completely inappropriate.
I wonder if the lenders are aware of how much title companies are jeopardizing their loans by employing cheap, unprepared signing agents?
I did learn one thing, though. It was abundantly apparent, after the signing, that I would never ever under any circumstances want to be the signing agent for any loan to Hugh Nations’ daughter

| | | | | I am so pumped over this, is just have to share it Posted by HisHughness at 7/20/2011 2:42:00 PM | For weeks I have been beseiged by spam from some spammer whose email address begins with "info@," but the remainder of the address changed for each email. Consequently, I could not block the emails. I was getting dozens every day.
Then I FOUND A WAY!
I set up a filter in my Yahoo account, where you can identify the incoming mail to be sorted by the various components of the address, and even the contents of the message itself. Now all that trash goes directly to Trash.
Life is good. God is great. And as long as Hershey's keeps making chocolate bars, I'm one happy camper. I'd be happier if PeeBee The Platinum Blonde wasn't in Tampa, and I'm thinking of forwarding to her the contents of my trash folder en masse just out spite for the move, but I'm still one happy camper. |
| | | | | LSI has a new confirmation form and new NSA instructions Posted by HisHughness at 7/20/2011 12:37:00 AM | Among the new instructions is a demand that the NSA not keep loan documents in his/her computer.
Like many NSAs, I routinely hang onto computer closing packets until I am paid for the closing. As long as the hiring parties reserve the right to reduce my fee for an "error," I don't see that changing. The closing packet is part of my insurance against getting stiffed without justification. No packet, no way to establish that I didn't miss a signature, the HP missed sending me a document. |
