Uniform Notary Law

I went on the NCCUSL site to see how they are doing with their review of the Uniform Notary law I just pasted part of their findings below you can see the entire process by going to http://www.nccusl.org/Update/CommitteeSearchResults.aspx?committee=304

I wanted you to see that our issues are being addressed. By the way The NNA submitted a letter and seems to have struck out. It was a rather self serving letter from Tim. Keep in mind this is only a portion of the report and not all states adopt this law. Go to the link above to see it all. They are by no means finished

Further, industry representatives noted that the mortgage finance industry, particularly, is becoming nation-wide in scope and questions concerning notarization of real property conveyances and mortgages, amongst other records, have become hindrances to and increase the costs of transactions. Nationwide standards have been developed by the mortgage banking industry and Freddie Mac and Fannie Mae, yet local, disparate rules relating to notarization have slowed implementation of electronically-based transactions based on these standards. Michael Gordon, representing Freddie Mac, stated that they sought unification of state notarial law, noting that the notary is the only individual actually present to identify the customer. He stated that as high-dollar-amount transactions become more frequent and more widespread, the notary is central to the integrity of mortgage finance transactions. In states where notarizations are necessary for the transfer of interests in motor vehicles, local disparities also interfere with financing transactions. An overriding concern is avoiding imposition of undue or unreasonable costs on parties relying on notarial acts, i.e. avoiding ‘friction’ to transactions.

To summarize, industry desires uniform legal treatment so that it can implement nationwide processes and procedures without hindrance from purely local rules, regulators and other public officials desire uniform legal treatment so they can better understand their responsibilities and the effect of actions performed in other states, and both agree that uniform legal treatment would ease confusions which exist amongst the public, regulators and other officials and in relations with other nations.

I got an email from them in regards to a new document in the loan package that must be signed to comply with state HUD requirements. I have often wondered why the borrowers have apparently NOT seen a final HUD within 24 hrs on a refinance. I know it's a requirement on a purchase (no RTC there). Does anyone have more information on this requirement as they apply to refinance? Here is the email in part.

To ensure compliance with regulations and borrower satisfaction, one of our lenders, Advanced Financial Services, is adding an additional document to their closing package. Please take note, because this document must be executed at the closing table.



The document is entitled Acknowledgement of Disclosure of Final Loan Terms. In compliance with state regulations, this document ensures the borrowers have been provided with a true copy of the HUD settlement at least 24 hours prior to the closing date. The signature area of the document will display the borrower's full name in accordance with vesting signature requirements. Additionally, the borrower must hand date this document to ensure its proper execution. If the borrower refuses to sign this document, please contact Equity National immediately. Equity will contact the appropriate member of Advanced Financial Services to speak with the borrower. Failure to execute this document at the table may result in an incomplete closing transaction, and may ultimately result in the loss of the loan.



 
 
Comment question on the tpl discussion

My background was as a realtor prior to going full time as a signing agent. I agree that a TPL is the source for learning the "rules" of closing loans. I have often felt that a signing service not paying a notary was a violation of RESPA. Some TC's also created their own SS which consists of the same person at the same deask that clled you as the TC but is now the SS. The TC pays their SS and is the notary does not get paid, it technicallyis not a violation because the TC disbursed the funds on the HUD.
My question ( from the back left 40) is that the current licensed enities that can perform closings all have the requirement they have an escrow acct. Wouldn't statitory changes have to be made for the notary signing agent not requiring this?
As a courtesy I won't go into the effect of Gramm Leach at this point.

12 hrs of needed sleep and I return to quality discussions on NOT ROT. I was beginning to dispair!
I have been skimming threads trying not to waste my time on the attacks. Also wondering what I have missed in doing that. I do not discount those that have a harsher or more blunt delivery but the one minute rebukes (those that obviously had less than a minutes thought) were/are really getting to me. To the credit of some, a polite redirect for common questions are given. But it does get tedious sorting the wheat from the chaff.
This is not a comment to deny freedom of speech but one on the freedom to make your point. Name calling, and adolescent put downs does not make a point. If you have something to say please put some thought into it. You will get a better quality of consideration of your point.

Even though you are a neutral 3rd party, a lot of lawsuits will name anyone attached to the chain of events. All it takes is a desparate homeowner to say you said or did something and you will need an attorney. Remember, you are often the only face to face person they met in the whole process. Says even more about keeping a journal.

Fiserv is switching to DHL as its main courier. It is 2:00 and I still haven't gotten the doc's for a 1:30. I just printed them but now the borrowers are unavailable.
I know of 2 drop boxes for DHL in this area. This is insane.

Has anyone ever used Privacy Guardian? The PR is great and I like the"shredder" option to eliminate borrower files. I was wondering if anyone is using it and what they think of it? I downloaded a free trial so not all the options are there.

My understanding is that they are a non profit organization or association. Do the mebers get an accounting of the activity and treasury? I am asking in reference to general organizational information of such entities. For example obviously there are employees and they must be paid. Is there a year end accounting to the members of earnings and costs?

I got a call to go to a small town pretty far from me. On Not Rot it said 74 miles. that didn't seem right so I mapquested it. 102 miles which seem more in line to me. How does NOT ROT determine the mileage?

But Diane Cipa has closed her blog. I liked reading that on occaision because she pointed out problems with the signing agent field. Yes she made us mad at times but she had some valid points especially since we ourselves complained about the same issues. Further more she pointed out things from her perpective in the TC that had not occurred to us and that we needed to address.
Be lieve it or not, I will miss her!
