Massachusetts Notaries Given A Reprieve

Massachusetts has issued a 'FREQUENTLY ASKED QUESTIONS AND CLARIFICATIONS' for Executive Order 455 (03-13) at this link: http://www.lawlib.state.ma.us/notaryfaq.pdf

All notaries now have until April 19, 2004 to comply with the Executive Order.

What does this mean for us? Can we still do closings?

I just called the Goveror's Office of Legal Counsel and was told that as of April 19 notaries could no longer do loan closings. If anyone has received different information please let us know.

Says to me we can still do it, and we are agents of the bank. As usual, we can do HELOCs and refis.

The answer I got was that unless you are an employee of the bank you can't. I'm going to the NNAA training seminar in Worcester on 2/13 and hope to get a definitive answer from that which I'll post.
