Go to signing without HUD? I went, and now no pay!

I was hired by Richmond Abstract of Florida in July for a last minute signing. (They called me at 4pm for an 8pm closing) The edocs were sent to me without the HUD. I tried calling Richmond Abstract Title for hours, even the cell number that they gave me. Only got voicemail, so I left messages. I went on to the signing that evening and the borrowers were not happy with the terms of loan. They did sign, but told me that they would probably be canceling using the 3day RTC. The next MORNING I received the HUD emailed from Richmond. The next thing I know, Angelo from Richmond is calling me APALLED that I went to a signing without the HUD. I explained the situation, and he said that I should've never gone...and to make matters worse, the lender was blaming the fact that the borrowers were canceling on ME! The lender said it was absolutely unprofessional for me to go without the HUD. I have been trying to be paid for my service (I even have cell phone records showing how many times I tried calling Richmond to tell them there was no HUD), and Angelo seems to think that I shouldn't be paid because the loan didn't close AND I went without HUD. I think that I should be paid regardless of loan closing because the borrowers signed, and I tried everything in my power to let them know about the situation. What do you think??? Am I being ridiculous? Honesty won't hurt my feelings...I really want to know what others think. Thanks!

Going to a signing without a HUD is a no-no, but it sounds like you did everything you could to try and get in touch with them. Some companies do stress the fact that if you don't get a HUD, you don't go to the signing and if you do you won't get paid. That should have been set out on your confirmation. They probably should have given you the option to go back the next day and get it signed at your expense, but to not pay you at all isn't really fair. Sounds like they don't want to pay you because their deal fell through.

There is a Hud Waiver which I have used on a couple of closings. I am not sure where to get my hands on one of these, but if I do, I will post a message for you.

Hey KC/IN, I did try to get in touch with them many times. Even when I explained this to them and faxed my cell phone record, it did not matter to Angelo at Richmond. Since I had no confirmation (it was such last minute), I really didn't have much to go on(as far as their rule on HUD's). I agree, Angelo doesn't want to pay me because his deal fell through.

I left a message for the manager, Tabitha this afternoon. I received a call back from her assistant, Jennifer. She said that she needed my address to send me a check for my gas and printing expenses. I said that would be appreciated. So, I gave her my address and then asked her some questions...like if they are incorporated, etc. I wanted to know all of the pertinent information for a small claims court case. Then, all of a sudden, after being placed on hold again, I was informed that my full payment would be mailed to me today. It's a shame that I had to go to that extent to get money rightfully owed to me. I'll be very interested to see how soon that check gets here...if ever. Smiley

This doesn't help your situation, but I'm on my way out the door for a 1st and 2nd. I received the e-docs about 3:00. After printing everything, I was assemblying the packages so I could photocopy them. The docs were scanned into PDF and they are horrible -- to make sure it wasn't just my printer, I looked at the PDF files on screen and they look like a faxed copy that has been faxed about 8-10 times. The Disclosure Statement and the Loan App are completely illegible, as well as some other docs that aren't quite as important. I called the SS. It's too late for new docs to be sent to me, so I'm on my way to remind the borrowers that they have 3 days to cancel and to hopefully get a fax number for them, so the illegible docs can be faxed to them tomorrow. It should be an interesting signing or not-signing.

Normally they are right on top of it and it is not even the SS's fault -- because of the time differences though, the title people were already gone for the day to get me new docs.

The saga of the signing is that I was about 3 miles from their house and stuck in traffic. I called to tell them I would be about 5 minutes late, at which time I was told that they had out-of-town visitors and a birthday party to attend and if the signing couldn't be finished in 10-15 minutes, that they couldn't do it. Yeah, right -- a 1st and 2nd in 15 minutes flat!

When I called Borrowers on Saturday and spoke to Mrs. to advise of tonight's 6:00 p.m. appointment. I ALWAYS give borrowers my cell number and tell them that if, for any reason, they will be unable to keep the appointment, to call me. She never said anything about their conflict and she never called me at any time today or before I left the house -- BUT when I called to say I was running a few minutes late, she said Wednesday is good for them.

I don't know what it is lately, there have been 3 recent signings that they will not return my confirmation call or they are runnning late or something else that is just inconsiderate. I do like what what I do but people are pretty amazing at times I guess no matter what you do.
I also give a couple numbers to the borrowers "just in case" doesn't seem to matter though.

You can't win for losing in this biz. If you wouldn't have gone to the signing "because you didn't have a hud"... they would have punished you for that as well. Being that you called numerous times... and couldn't get a live person... gave you no options.... but to assume they wanted you to go (unless written instructions were provided to you to not proceed to the signing without a hud). I had signing recently where instructions were very clear for me NOT to go to the signing without a hud. The hud didn't come and when I called... they told me to go to the signing without the hud... go figure! Luckily, they called during the signing and told me the hud was ready... and again, luckily, the borrower had e-mail and a printer.... and... wala... we had a hud at the signing.
