FYI: I received a call from Sheldon Lukowski, and LO with Ameriquest in Ranch Cordova CA asking me to do an emergency closing for him. He said they usually use a signing company but he found me himself and needed a closing done immediately. I spent OVER three hours on the phone with him and different technicians trying to get their documents to print without success. The LO called me back the next day (Saturday morning) and asked me travel to the North side of the city and pick up the docs from an Ameriquest office. It was a 45 minute drive, but I agreed because the LO offered me $200 to do the closing. I made the trip and then traveled back another 30 minutes to the borrowers house. I spend 1.5 hours with the borrowers, closing the loan. I worked with the borrower and was able to get them to give referrals for Ameriquest. The LO told me I would be paid within two weeks for the assignment. Two weeks came and went. I called the LO. He told me that the check was mailed to me via US mail and returned undeliverable. This was a lie, but I believed him. He said he would fed-ex out another check. He gave me a fake fed-ex tracking #. Of course the check never came because it was another lie. After calling over and over, I finally got a hold of the LO again. He told me that the check was accidentally sent to Vital Signings and then he would have a check send fed-ex to me and I would have it by 10:30 on 9/13. After insisting, he provided me with a fed-ex tracking #. Well, of course, the check did not arrive. Again, the tracking # was fake. After calling the Rancho Cordova office and talking to a supervisor named Ryan Delfs, I was told once again that I would have a check by 9/20. I am working within the NNA guidelines to obtain my payment. I have reported Ameriquest, Ryan and Sheldon to the BBB. Also, did you know...iIn Indiana anyway, you can sue in small claims court if you are a sole proprietor and if the company has an office in your state? Be careful doing business with these guys. I am sure they were paid for this deal, but they are trying to cut me out.

Are you saying you do not, or that you do, have a small claims court claim?

If you do, as simple as it is to do a small claims court petition, you nearly have one in the above posted information. If I were you, which I am not, of course, but I'd get ready to file the small claims court suit.

Gather your "evidence." Get a form from the small claims court (if it's do-able) and get it ready to file. Make a copy of it and mail it via CMRRR to the borrower, title company and the defendant (Ameriquest-Sheldon/Ryan) plus send a copy of it to the top corporate offices of Ameriquest. Do a cover letter advising all the borrowers that Ameriquest-Sheldon/Ryan is the responsible party, but you would appreciate the help of a written statement to the effect that you completed the assignment satisfactorily for the judge--preferably notarized like an affidavit and tell them the suit will be filed within 14 days from the date of the letter.

If you do not get any response, find out if you can subpoena the affidavits or written receipts parties may have regarding the loan in your state for small claims court. Follow through on that.

File the suit and figure up what you will settle for...including fee, costs of collecting and costs of court. It would be better to settle than to wait for it to come up on the court docket. I have no idea what the NNA guidelines are for collecting, but you have to make sure that you get paid. The NNA cannot do that for you. Be relentless ...and thanks for the heads-up.

Hey I feel for ya. It regards to Ameriquest I would stop dealing with the LO and request to speak with the processor (ask specifically for the Senior Processor of the branch. The funding of an Ameriquest loan is somewhat different to others as I believe the title company is not sent the notary/signing fee as part of disbursement but rather the lender withholds it and disburses upon invoice and they can be quite a slow pay. (sometimes they are 120 days out) It will help you to go into the branch (go in---the processors are on the phone all day with one thing or another and face to face makes them get things done) if it is reasonably close and talk with the senior processor and have her invoice it for you to corporate Ameriquest. Ameriquest does tremondous volume and from personal experience, not just as a closer, now that these things do happen. Make sure you have the loan number as it will help a great deal. To be honest and I know you don't want to hear this it truely is not in the LO's control but him lying to you and trying to be anything but helpful is shamful. Try to advoid what is their "last week to sign", or "the funding week". Last week to sign starts if it is a 30 day month on the 16th and ends on the 23rd. The funding week is right after ( the 23rd to the 30rd) that. Going in what they call the second week to originate will be most productive ( the 1st through the 7th) as the processors are usually slower and look at this time to "claen last month up." Surprisingly enough the Branch Manger would end up going to the processor for something like this to so going to the source directly will be the best. If you go through corporate Ameriquest they will go back to the processor of the branch so your best is actually the processor. I do know people that have went as far as place judgements on Ameriquest and still have not been paid. Also in the future make sure you are on the HUD where it says Notary Fees---you need your name there. P.S. Ameriquest when they need to have a loan signed will pay anything. Standard in my area is a whooping $400.00 if you believe that and they willeventually pay. Get that processor. Best Of Luck, hope this helped.

Brenda---This has been successsful per some of my colleagues in Michigan--specifically Kent County. If you want to be paid the processor route at the branch the loan originiated out of is really the best----If the processor at the branch will not help you , go above the branch proceesor's head. Each area/region of Ameriquest has a area/region processing manager.
Ameriquest is a strange bird in that they always focus on future business at the branch level and look at loans as finished when it has funded. I am trying to remember the formal title of the area/regional prcessor but at this time it eludes me. I do have a contact I can call tomorrow and get names most likely if you know what area/region of Ameriquest the loans are from. To get this just call the branch and ask whoever answers what area and region they are a part of.
The third party vendors are paid at Ameriquest after being invoiced through the branch to corporate. This is a processor role. I would stop trying with the branch manager, the LO and corporate Ameriquest and go to the branch and meet with the senoir processor. I see you as most successful this week as "funding" has just ended. Best Of Luck

Thank you ItsMe123, I now understand you are saying you have heard from notaries in Kent County, MI that they have judgements placed on Ameriquest that have not been paid.

The original post I queried was in relevant part

The post you are referring is posted in full below. My mistake - I interpreted that to be a post on how to get paid by the processor route in Kent County, MI. Thank you again for clearing this up for me. I could not figure out why I should go the processor route.

Wow, thanks for the reply and advice. I will do exactly that. I will be relentless in pursuing payment. As you may know it is not just about the $200, but about being the little guy that the big guys try to "use" along their way. Thanks again.

I am also owed $300 from RC for April 2004

I am still in the begging and pleading mode.

If that doesn't work, I will file an attachment on the borrower's property.

No more Ameriquest loans for me. No way. No how.
