I need to know if this has happened to you....

I recvd a call form a SS that I did a signing for over the weekend. She stated I needed to go back out because the wife's signature did not include her middle inital! I feel as if I should get paid for going back. All of the documents were completed and signed properly. I have worked with this company in the past, and I feel as if my fee is pretty basic, and truthfully lower than what I charge others, but shouldn't I charge for going back out there!?!??!?!
Besides, gas prices are going ONE CENT down!!! AND... this signing took over 2 HOURS!!!
Please let me know your opinions, as we dela with the same dilemma.

If the docs were drawn up with her middle initial and you didn't get the proper signature, it is your fault and you just learned a valuable lesson about double-checking before you leave the table. If the docs were drawn up without her middle initial and she signed just as the docs were printed, then they have no gripe with you and they should at least pay a partial signing fee for your return trip. IMHO, of course, YMMV.

Thanks for the info. I don't remember if it did right now. They will be overnighting the docs to me tonight. If it does have an initial, then yes, you are right, it was my fault. I will then have learned a very valuable lesson! Thanks for your input. I appreciate it.

If the signature line was printed Jane G. Doe and she signed Jane Doe then you have to go back for free. Sorry!

However, you can have them fax the incorrectly signed document first as proof that it was signed incorrectly. If they won't do this I wouldn't go back for free unless it was a good client and it could cost you future business. I once had a company tell me to go back for an incorrectly signed signature. When they wouldn't fax the doc to me thay back tracked and said it wasn't shipped with the other docs. It came out that they had misplaced the doc and had to pay me an additional to get the doc resigned.

Moral of the story: Have them prove it was your mistake before returning for free!

Thanks Marie. I should have done that... but I was really busy when they called! They told me that THEY woulddn't even get paid for it, unless it was fixed! I know that this borrower is going to fuming!!!

It is standard procedure in this business that the borrowers need to sign as it appears. If they refuse to sign as their name is printed, let us know before the docs go back to the lender. If its an issue with the borrower having an attitude of "that's my signature, deal with it!", we pay our notaries the full fee and expect full pay form the title/lender if the borrower signs. However, if the LSA did not have the borrowers sign as the name(s) appear, we do not charge the title/lending company if the docs get kicked back the underwriter.

My partner and I have never tried to rip off a notary EVER in the 8yrs we have been in this business and have NEVER had a collection issue with a notary. We also have never charged a title/lending company for a mistake one of our notaries (me included) has made. All we ask is that the LSA work with us and we will do all we can for them.

A Google search for "InkWerk" didn't find anything notary-related.

Ich hab kleine Deutsch, so I'm not sure about the Sites in Dutch or German, but I'm betting that they're not your signing service.

I have had some people refuse to sign with the middle intial because that is not there legal signature.

What I do is call and let the SS or Title company tell me what they want me to do. CYA

If the SS balks at paying for the extra trip, still claiming it was your mistake, I would call the borrowers and ask them to look at the signature pages of the DOT and note and tell you how the name was printed. If there was no middle initial as printed, then you have a good argument.

As a general rule, when the typed name has a middle initial, I carfully point out to the borrower that they must sign with the middle initial - not full middle name- and they can't leave out the initial. If the signature is a scrawl, like a doctor's, I ask them if the middle initial is in the signature. I may not be able to see it, but if they say it's there, it's there.
