Loan cancelled this morning, e-docs printed, no one called
Hello: Hope there's someone out there for advise.I was called by a SS yesterday for a 2 loan signing/1 signer with e-docs. We negotiated and the signing was to be done yesterday. Borrower was missing in action as his agent didn't tell him that he was doing a signing of a loan. Borrower returned home last night a 9:30, we spoke for some time - nice man- and made an appointment for tonight. In the mean time, I printed out numerous copies of the e-docs as the escrow company chose to shrink some and they were cut off and sloppy. My last communicatn with escrow was at 9:30 this am. Where I asked confirmation of what dates we would be changing on the docs for tonight.
Apparantly, borrower emailed escrow this morning at 10:00 and cancelled the loan. This was roughtly 30 minutes after my last email to escrow. Thank heavens this nice borrower called me this evening to state that he cancelled this morning as NOT ONE person from the SS or escrow chose to call me.
Just left message on SS cell phone stating that loan was cancelled this morning and no one bothered to call me - I had reserved this time, which was to be 30 minutes from now, and the borrower calls me. SS called back and said he didn't know and that I wouldn't be paid as this is how the business goes.
OK, I want to get paid! HE said he would take care of me with other assignments. I'm not sure I want that if this is the way they do business.
Any advise?????

What does your contract with the SS say about cancellation fees, doc printing fees, etc? If nothing, you might want to at least demand a fee for printing the docs. Other then that, since you didn't actually drive to the borrower and then it was cancelled, they probably won't pay a fee for that. What a hassel all the way around!

I've been really lucky and not been taken advantage of in my career yet. This has me really pissed off.
Should I do a direct bill to escrow as they had me chasing around and didn't even bother to call? What do you think?
I've already decided that SoCal Notaries is probably not the SS for me.

You should get paid your edoc printing fee. Regardless of what they tell you, I would print an invoice and send it to them, and keep on at them until they pay you.

SS said he wouldn't pay. I'm wondering who should I bill here? I have numerous emails from the escrow person that was messing up the doc shrink and causing me to redo. Perhaps I should be billing them. Borrower said his agent didn't even say that I would be signing with him yesterday. Looks like a real loose bunch of outfits all the way around. SoCal Notaries byw

If a SS hired you, then you bill them. He may say he won't pay, that doesn't mean you cannot invoice him, and put on it payment expected within 30 days. Then when he doesn't pay in 30 days, send a reminder, and then later a demand letter and then later a final demand letter. Finally, go to Small Claims Court and get the paperwork to file a small claims against them for the money, and fill it out and send him a copy - and make sure he is aware that he will be responsible for the cost of recovering your money.
(I just told someone recently to do this very same thing as a SS shorted her $25 and was not paying it. She got her money!)

I have an email confirmation of the negotiated rate from the SS. I could print the numerous emails from the docs person at escrow and attach all with an e-docs fee, and then pursue. Stay away from this company!

Sylvia's correct. The SS hired you, and they should be the ones to pay you. If they want to go after the Escrow Co. for your bill, then that's their business. Bill the SS.

Stuff happens... I know you're upset over all this, but if you want to bill the SS... Then bill the SS. If the SS doesn't pay, take it as a tax writeoff. I'd be gracious with the SS and thank him/her for the business and tell the SS you're looking forward to doing business with them in the future. Next time they give you an assignment contact the borrower yourself! If you think the SS is flaky and you want to make money pick up the slack and make the phone call to confirm the closing before you print out anything.
You're a professional and by taking these steps you're showing that you are!

I agree with Maggie. Last minute cancellations are part of our job. I think it's fair to try to get an edoc printing fee, but sometimes it's better to kiss off a few bucks worth of time and supplies to ensure future business. Being flexible and agreeable is a big part of the reason so many companies use me over and over again.
As my mother was so fond of saying while I was growing up, don't cut off your nose to spite your face.

we all need to make sure we have inclusive contracts that protect us in these events, clauses written in allowing to charge late fees and interest on deliquent payments as well as printing and travel fees if signing doesnt happen. independent notaries need to unite against unfair practices that make US foot the bill when someone else hasnt done their job(s). I saw a contract from a SS recently that makes the BORROWER responsible for the signing fee if the loan doesn't go thru for ANY REASON! that just aint right. (any reason?) boy thats passing the buck. These kinds of "dont hold ME responsible contracts" are bad for our business and leaves US holding the bag. What happened to doing your job right(yeah I said RIGHT) so the next person down the line can do their job right. questionable contracts, nonpaying SS's, fraudulent business practices... all things that we need to protect ourselves from, make your own contracts, or find a good one to use that covers all the bases, dont blindly sign any contract an SS puts before you, they are protecting their own interests.. not yours.

Loan back on today. Looks like I have a flakey SS, Escrow, and Borrower.
By the way, I do contact borrower immediately when I get the job. This man has changed his mind MANY times. So while it is good practice to call immediately, it didn't appear to work in this case. Even this morning, borrower called again to change appointment time after setting another appointment for this morning.
The signing is passing like a kidney stone!!! I wish I never accepted it. I'm getting too little money here, this has taken me days of aggrevation, and I just have a feeling in my gut that this man will eventually cancel.
