Can the witness on a POA be a family member to the signer

Depends on state law. Some states specifically forbid family members while others do specify. However, it is generally accepted that anyone who has any interest in the process, transaction or possibly benefit from the action, should not be a witness. This usually excludes most immediate family members. As a rule of thumb, I always recommend a disinterested non-family member as a witness to the signing of POA. Especially, on Durable POAs that have some pretty wide sweeping responsibilities and capabilities. Limited POAs for a specific purpose, might be okay since the family member may not have any possible benefit. But, just to be safe, I suggest not using a family member.
