Docs had maiden name borrower signed with husband's name

Quick question: I got a call from the title co that the closing I did for them should've been signed as borrower's maiden name whereas it was signed with her husban's name. Now they want me to go back and resign all the docs. Should I charge them for thisespecially when it comes to edocs? Also this loan was a little messy as the borrower was thousands off.

How were the docs drawn? Did they have the "spouse's" name as "Jane D. Maidename"? If so, did you explicitly tell her she needed to sign exactly as her name appears on the documents? If so, then you may have a case for second signing fees, otherwise, this one may be on you.

Further, how was the signer ID'd?

The wife may of owned the property before she was married. I have seen deeds in the maiden name and docs in the married name before and I ask for a wedding certificate which shows the maiden name. If I can at the time I'll make a copy and send it with the package.

I had a similar situation the other day. Property was in the wifes maden name. New loan and deed was to be in maried name. Deed came through with wifes maden name on first page and married name on signature page. Cut a short long story short. The deed had to be redrawn.
