Message for PAW_FL or anyone else from there
I'm doing a signing in Wisconsin for a property in Florida at an hour from now. Minnesota and Wisconsin don't require witnesses. Will I need a witness at this signing since it is for a property in Florida? And if so, would they only sign the mortgage, or all docs with space for a witness signature.

Florida DOES NOT require witnesses on MORTGAGES. However, if there is a DEED (Warranty Deed, QuitClaim Deed, etc.), then TWO witnesses would be required, one of which can be the notary.

While Fl does not require witnesses on a mortgage, it could be a requirement of the lender and therefor required for the mortgage.

Paul's response was correct!!!
He was not asked what the lender required, the question was what Florida required.
If the lender was requesting witnesses, then the original question would probably not have been asked, but as there were obviously no instructions as to witnesses, the prudent SA was checking to see if they were needed.
Get off your high horse! Pity you have nothing better to do with your time than scrutinize Paul's posts for errors. Most of us would trust Paul's posts than someone who hasn't the guts to post their name.

RE-read original pot--it asks should there be W's in all spaces provided---answer is YES if that is what lender wants---misleading answer to just say FL law does not require without the qualifications to the answer. Problem with non-lwayers thinking they are such.

If the lender had specified they wanted witnesses to sign there, then the original poster wouldn't have asked the question, they would have known the answer.
I see witness places all the time, sometimes I will sign as a witness, mostly I don't though. Never had one come back and say I should have got witnesses.

To which I answered. I'm sorry that your Twitness doesn't like my answer. I answered the question, no more, no less, as it pertains to Florida statutes for recording and property conveyance. I don't make any assumption as to what the lender may or may not require as that was not asked. (The name of the lender wasn't even mentioned.)
Since the answer to the question is NO, by Florida statutes, the rest of the question is moot. (If you don't know the meaning of the word moot, look it up.)

It is not required, but when I did a FL property here in Ohio for Ameriquest through Vital, it got sent back to me for witness signatures on the Mortgage. I told them it wasn't required except for deeds, but that was their policy.
So, if your instructions say to get witnesses, it could be a lender requirement.

Thank you to all. I will contact the lender. There were no instructions and it is the standard Mortgage form that always includes spaces for witnesses. Anytime I have had to do Florida property in my New York State counties, 2 witnesses were required of which I could be one.
