The Affidavit of Consideration.
I contanstantly have issues with this document. This is a NJ form that has to go to the recorder's office any time a deed (not deed of trust, we use a mortgage in nj) is being signed. Every title company in the world likes to include a black Affidavit of Consideration with the package when a deed is involved.
I have never once, in my life, seen a borrower know how to properly fill out this form. It is a very complex real property form (percentages, deponents, the whole schebang). I have requested to MANY MANY title companies to have someone at title fill out the form properly and supply me with the completed for to present for the borrower's signature. I always seem to get the "Just have them sign and you can notarize" (NOT WITH BLANK SPACES ALL OVER THE PLACE!) or "just have the borrower fill in what they know and we'll do the rest" (AGAIN, HELLO!! NO BLACK SPACES!!).
So two weeks ago I go through this whole schpiel with a Title Co in FL, "just get them to fill in what they know." OK, borrower fills in what they know and then puts an "X" in all blank spaces (per nj notary manual). Return docs. Get call, have to have borrowers resign this doc. (DUH! I TOLD YOU THAT BEFORE THE SIGNING!) Ok, I'd be happy to help, my fee is $XX.
I am tired of going through twelve-hundred phone calls just to fall completely on deaf ears, and only end up going back out a second time (always at a fee). From now on, they send it blank, the borrower is gonna fill in what they know and "X" the rest. They wanna pay a second trip... fine with me.
I AM JUST SOOOOOOOOOOOOOOOOOOOOOOOOO FRUSTRATED! I am honestly TRYING to save the title companies TIME & MONEY by getting this right the first time. NOBODY WANTS TO LISTEN, and then when it's wrong, they FINALLY fill the form out and send me back out. GRRRRRRRRRRRR.

and the BO's did not want to sign or fill it out b/c there was no "sale" taking place. (There was a deed inc. in the pkg. changing Mrs. last name.) We were closing at a hospital in PA (for their home in NJ)and I couldn't get a signal on my cell phone for advice from the title co. I put the form aside and when I could go to a place in the hospital where I could get a call through, I found out that they did indeed have to fill that form out and we were all hoping they didn't have to! lol I think a lot of it was blank, but it had their sigs!

A mexican midway... well you get it... is a very smooth way to drink a double espresso with about 400 extra calories...

i agree wholeheartedly.......i drafted the following form that i attach to the document after i have the borrowers insert the words that they know should be in the blank spaces [which usually they don't] and have them draw lines in the others. i have never had a call back since i have been attaching the document, which by the way i print on red paper so it really stands out.......
It is illegal to notarize a document that has blank spaces contained in the document, therefore there may be incorrect words inserted in the blank spaces or lines drawn in the spaces to complete them so they are not blank.
