Another bad company to add to the list

Getitsigned notary,Costa Mesa, Ca. I printed the docs, faxed back 30 pages and made copies and split the package to send to 2 locations-- BO canceled and she said she won't pay me anything..just a warning. I know I should have asked her about refusal payment, and I did not. But there was nothing in her confirmation about none or partial payment for refusal or rescinded loans.

If it was not disclosed in you CL, just take them to small claims court.

You did your job, you deserve to get pd.

I am so sick of co.'s thinking it is ok that we do not get fully pd if the loan does not fund. I can understand (somewhat) re: no signs, but rescinds are totally different. And shame on all of you notaries who are willing to work w/co.'s that do not pay full fees for no funds (and I know there are a bunch of you out there because I posted on this a few months back & was told I was a fool to refuse to work w/a co. that only pd half fees on no funds.). Sometimes its more about the principle than about the money. I do not work for free!!!

She cannot change the contract arbitrarily. She is still obligated to pay you for the job you hired her to do. I agree that you should take her to small claims, but try contacting the TC first to let them know of the business practices of the SS they are using and ask for assistance.

If that doesn't work, fill out the paperwork for small claims dated for a short time in the future and fax her a copy with a demand letter and a deadline for payment before you intend to file. It floors me they way some of these companies just "decide" they will not pay for services rendered.

I have seen all the time in the redraw documents that the borrower is been charged full signing fee for the first signing. So SSs are getting full payment for the no signs,not funded loans. Even if they just get partial payment it is their cost of been in business. A SS can schedule hundreds of loans in a day and we can only do 4 or 5 in a given day.

I bet the SS was paid by the TC!! I agree you should call the TC ask them if the SS was paid.

I'd let that woman know that your fee is not dependent on the loan funding. You did your job and expect to be paid the agreed upon fee or you will see her in court. We are professionals and it is up to each of us, the Notary, to tell companies what we CHARGE, instead of just accepting what they PAY. Establish a fee schedule and let companies know UP FRONT, what you CHARGE....if they agree, good, but if not, oh well.

Some will, some won't, so what....NEXT !!

Re: gave her until the 15th of December-then I add 50.00

and file in small claims. Fortunately i have emails from her thanking me for a job well done and our agreed upon fee. Court should be a slam dunk. she lives in San Diego area. I hope she enjoys her trip to the S.F. Bay area!! I told her I do not work on commision. I expect to get paid.!!

to cold and rainy in SF...

enjoy your trip to SD... which you may have to do (it's a grey area, long story) but the deal is you can add reasonable trip expenses to the case.
