I will not post the company name out of respect for this SS.
On December 22nd I had several signings and a set of docs came down without a previous confirmation. I called the title comapny and they told me who the SS was. I then called the borrower, remembering that I accepted this a few days before. I told them that I would not make the 1pm appt and that I could see them that afternoon, all was fine.

In sending back 7 pkgs, I sent these 2 particular docs to the same TC, as they both were from them, different addresses as I found out later. I was on the phone with the TC on the 29th. She stated they did not have the docs and did I send them back to the lender? She said it was supposed to fund today. She called me back an hour later and told me she found them at the lender's and they were faxing over the security instruments so that it would fund on time.

I get back from vacation and there's a voicemail from the SS that says they cannot pay me anything because I cost them $300.00 to make the borrower happy and that it didn't fund on time. I explained my situation to the SS after talking to the TC and told them that it funded and that the checks for disbursement went out the following morning.
The SS still insists that the TC isn't paying them for this and to top it off, was told not to use me again, even though I had worked with them in the past. The reason the SS says is "the TC had to adjust their figures and reimburse $300. to the borrower for funding a day late.

I'm sorry, but I am just not grasping this. Anyone?
Don't beat on me, I already kicked my own ass over the delivery. Which, I would feel better about should they have docked me the ship charge instead of NO payment.
I did the job, printed two copies, drove out, got it signed right and BAM blacklisted! I know it was a screw up, but at least I didn't send them to some flower shop in India or something where they'd NEVER be found!

As you've already spoken to TC, think I'd call them again to check veracity of SS story. If true, be prepared to grovel. But I would think that if they were all that unhappy, you most definitely would have heard about it from TC. At this point, what do you have to lose?

I would check with Title to see if it did fund on the 29th as scheduled or if they did not get the items from the lender in time to fund. The adjustment was most likely made to the borrowers payoff and because of the Holiday weekend, if the payoff was large enough it could have added up to 300.00.

my suggestion would be to allow for a cooling off period after you check w/ the title company. they are upset right now and reactive. If you wait a bit and call and again apologize but do not get defensive or offer any explanations as a true apology ends w/ a period ..... also make it all about them not you as they need some calming ..... They do know you are professional and know your work well but as I said they are in a reactive position right now.

this is strictly mho. I wish you the best and hope this can be straightened out sooner than later. GL

Charm, I feel your pain ....

About a year ago, I did something similar. A busy day and I switched two labels without catching it. Fortunately for me, it did not cause a rate lock loss or anything. Still the TC said they weren't going to use me again. I just got busy and did some big time butt kissing and I am getting work again from them. So all is not lost. I did learn not to get in a big rush ..

It's funny, though that the SS's, TC's, lenders, borrowors, and everyone else in the loop can make tons of mistakes and nothing happens. We make one and get bent over the desk ........ Oh well, life at the bottom .........................
