I know there have been many messages about the new requirements, however I just need one last clarification.

- Do I have to have a picture passport already sent to the state, or can I do a signing, and be in the process of the passport?

Also when notarizing for child custody papers do I need anything extra?

My main questions is I have not sent this passport picture and application to the state as of yet, and I want to do this signing. So can I?

1. It isn't a passport that is required for a notary application. Maybe what you meant is a passport size photo.

2. Unless you have a valid notary commission in your hands properly issued and recorded, you may not perform ANY notarial act whatsoever.

3. Child custody papers are handled like any other notarial act.

4. Read and re-read your notary handbook, the answers are in there.

Thank you John for your quick response. I have been a notary since May of 2006, so that would mean that I am licensed and commissioned. I mean everything was filed with the county clerks office and such. I just haven't done many signings and I wanted to make sure that I have all my ducks in a row so that nothing comes back to haunt me so to speak!

If you've been commissioned since May 2006 that means that your commission is valid until May 2010. The photograph requirement will come into play when you are up for renewal.
Just watch your p's and q's and nothing should come back to haunt you.
