I don't think that document was signed in Texas but to answer your original question - in Texas, as in most other states, there has to be a notarial certificate.

An invalid notarial act doesn't necessarily invalidate the document, but it does make the notarization useless. In this case, one party apparently didn't sign, which would potentially have more of an impact on whether the document is valid and enforceable than an improper notarization.
