A notary in Roseville called me this morning. She is unable to support her position so is calling other notaries in hope of finding some firm ground to prove her point. She is researching what to do. Frankly, I had not heard of this before so am researching a bit also.
The bank wants a lady's name listed on the acknowledgment twice. One person whose name will appear twice.
The signer is signing as trustee and as herself on a Deed. As follows: Signed once as 'Betty P. Fence' and again as 'Betty Privacy Fence,Trustee.' Then, the bank wants both names in the acknowledgment. "..... personally appeared Betty P. Fence, Betty Privacy Fence, Trustee who proved to me..." This was preprinted. The notary struck through and initialed 'Betty P. Fence' and the word 'Trustee.' She left the longer name to cover the shorter name.
Now they have sent it back to her to have her redo the notarization with the lady and informed the notary she can only strike through the word 'trustee.'
She explained she left the latter name to cover both and the bank won't have it.
She cannot locate anything to back up her stance other than to say the bank's way looks like two people are being acknowledged.
Any help out there for a fellow notary in CA? |
