I can't answer for New York or the other 48 states, but in Tennessee you have to first be a commissioned notary in TN before applying and getting a commission as an online remote notary. And there are other stipluations/criteria as well, all outlined in the legislation setting up RON in TN.
And just because I am a commissioned RONotary in TN doesn't mean that I can conduct online notarizations if or when visiting the grandkids while on vacation in Michigan. TN legislation contains the following clause: "An online notary public may perform authorized notarial acts by means of an electronic interactive two-way audio and video communication only when the online notary public is physically located within this state, without regard to whether the principal is physically located in this state at the time of the online notarization". So I have to physically be in the state when conducting RONs.
Oh, don't expect to get rich off this anytime soon. About 2 years ago I had the opportunity to hear a former--yes former--RON notary based in VA speak. One reason she was a former RON was she couldn't set her own fees. The amount of income didn't justify the fees and expenses of RON. And TN has in it's legislation verbiage setting fees for all RONs. 1360-07-03-.06 FEES. An online notary public, or the online notary public’s employer, may charge a fee that does not exceed twenty-five dollars ($25.00) for performing each online notarization.
