Usually, the RE Agent hasn't seen the CD until we are at the table. There have been times ugh the signer hasn't seen the latest. I print an extra copy with the signer's package. I explain (always nicely) that I'm not permitted to hand a copy of the CD to the agent but have provided an extra for them if they'd like him/her to have one.
When I did closings for Title Forward, same procedure with the copy of the CD and we were to ask the signers for written permission to have anyone extra in the room, including their RE agent. A log was passed around and all present signed.
