It's good you have extensive experience with Memory Care, and I would say you are probably plenty capable of judging mental capacity. Me? No way. And for those in the same boat as I am, I would strongly suggest you evaluate your own skill set and not think that just because you got a piece of paper saying you are a notary public that you are a qualified judge of someone's mental capacity. I have thought a lot about my skill set in that regard and have determined I'm a simple country notary who paid $10 to the Colorado SOS and got a commission. I would never presume to throw anybody out of the room (unless they were insanely disruptive) and hole up with a potential signer for 15 minutes asking a bunch of trick questions. Yikes. That's just too scary. Not my job. A simple 60 second interview, respectively asking the signer if they can tell me what they are signing, or what the document they are signing does or something like that will suffice for me. Treating them with dignity and courtesy.
I never want to hear that I told relatives/friends to leave so I could play psychiatrist with a bunch of questions that are not in the notary handbook, and then hear sometime down the road something like this: Well, Aunt Minnie said the notary asked her this and said the notary did that or however they interpreted what Aunt Minnie told them when in fact I said or did none of that. And I don't want them or anybody else asking me what qualifications I possessed to evaluate Aunt Minnie. Not going down that road. Willingness to sign and knowledge of what they are signing are good enough for me. But for the rest of you more knowledgeable than I, go for it. |
