There story on the New York Times website today, by Valeriya Safronova, with the headline "Passports May Soon Include a New Option for Gender Identity". There are already issues for people with a non-binary gender indication on driver licenses and state ID cards, who want a passport. The article does not address what would happen if a person chooses such a passport and then uses it to apply for a state driver license.
I think the main issue for notaries is in those states where "he" or "she" appears in the required certificate language (or in the language the lender or title company insists on). In terms of actually feeling sure the person in front of us is the right person, there's usually enough information to be sure without being certain about the gender.
