| collecting judgments isn't always that difficult, even when the signing service is in another state. I'm in PA. I typed up a complaint last night to file against a CA signing service (United Document Service, I haven't forgotten about you). I'm trying the title company one more time today. If they can't/won't help me, suit is being filed tomorrow or Thursday (I had promised them Monday but I'm slow). Anyway, I most certainly will win my judgment. Then, I'll file Depositions in Aide of Execution. The borrowers and the title company will be forced to come visit my lawyer to answer questions. If the title company does business with this company routinely (and I do believe they do) I will garnish their account and get my fee,interest and costs of collection. That should put a damper on the ss's receivables for a month or so. Of course they must comply with the Deposition order because in my state it's a crime to fail to appear pursuant to a subpoena and the title company is only 2 hours away - clearly the constable for his fee would drive that far. No title company wants to be involved in all that for a generic non-paying CA signing service. So, get your judgments and then find an attorney who does collection work - they know ways to collect. |
