According to the Associated Press, Mr West is back on the ballot. Court of Claims Judge Robert Redford found that the affidavit of identity wasn't even required for presidential candidates. The judge also rejected the state's finding that the affidavit was incorrectly notarized.
So what can I glean from what I can find online?
The form that was notarized didn't follow what it says to do in Colorado, where the notary was located. There was no visible staple hole in the paper. Maybe it was correctly notarized on the back. Maybe there was a loose certificate that wasn't attached to the form. Maybe the judge decided that even though it didn't quite follow Colorado law, it substantially complied and was good enough.
