Page 40 of the Handbook.....Civil code 1185(i): The person making the acknowledgment is the person NAMED in the document. In life, Alejandro and "Alex" can be one in the same but for notarization purposes, they are two different people (to me).
In a previous thread, a week or so ago, I said people are only one person at a time. I believe the discussion had to do with a married woman having paperwork in her maiden name with ID in her married name (or vice versa). Many disagreed with me and I see that I wasn't clear in the way I stated the issue. To clarify:
Jane Marie Doe (maiden name) Jane Doe Smith (married name) Elizabeth Jane Doe J.M. Doe-Smith
Good luck trying to get a DMV from any state to issue DLs in multiple sets of names. Jane needs to pick a set of names and get ID from the DMV in THAT set of names. That's who she is for notarization purposes. Again, the civil code says the person making the acknowledgment must be the person NAMED in the document.
Those four sets of names above can be all the same person but are four different people *when notarizing* because a DMV will only issue ONE license in ONE set of names, so Jane is ONE of those persons above *when notarizing*.
If Elizabeth Jane Doe brought paperwork for notarization to ME and the ID said Elizabeth Jane Doe and the document printed Jane Marie Doe, I wouldn't complete the notarization because Elizabeth Jane Doe is not NAMED in the document, per civil code 1185(i), page 40.
IMHO, Notaries ARE responsible for the content of the document TO THE EXTENT that the person making the acknowledgment is the person named in the document, the Notary is not named in the document and doesn't have any financial interest/benefit, and the document is complete and all pages are present. Whether the document has the proper legal verbiage, etc. would be for an attorney to determine.
The name doesn't have to be EXACT. The ID can show Jane Marie Doe and the paperwork have a variation of that: Jane M. Doe or Jane Doe or J. Doe - but when the names start changing, Jane Doe SMITH or ELIZABETH Jane Doe.....now it becomes an issue.
I personally would NOT notarize the signature of "Alex" if the license said Alejandro. Her nickname is her personal issue and I don't care about that. I care about the person sitting in front of me and whether that person is NAMED in the document. Alejandro is not NAMED in the document.
