Qualifications:

To be appointed a notary public in North Dakota an individual must:

• Have the qualifications of an elector as to age and residence; or
• Reside in a county that borders North Dakota and which is in a state that extends reciprocity to a notary public who resides in a bordering county of North Dakota. (If the person resides in a county bordering North Dakota, that person must designate the Secretary of State as the agent for service of process, for all purposes relating to notarial acts, including the receipt of correspondence relating to notarial acts.)

Term of Appointment:

A North Dakota notary public is commissioned for a term of six (6) years, unless resigned or revoked before that time.

The completed application, your surety bond, and a $36.00 filing fee made payable to the Secretary of State should be sent to the following address:

After the receipt of the fee, application and surety bond, you will be issued an authorization letter, which authorizes a vendor to provide you with an official notary seal/stamp.

The state of North Dakota requires all notaries public to purchase a North Dakota notary seal to authenticate their notarial acts. North Dakota does not require notaries public to use a journal or book to record notarial acts performed, but we recommend such a journal as another tool to help you in your business.
