I'm unprofessional?? really? Got a call yesterday at 3pm

to do a double seller signing at 9am today. Scheduler said packages were only a few pages each, I would have the docs in an hour or so, and they would pay $110.
Time ticks on and no docs. I sent email at 5pm to inquire, still no docs. get a voice mail at 7pm saying they have the docs and the total pages are 58 and they are reducing my fee to $85.
By this time I am on way to appt so I shoot an email summarizing our agreement for fee and receipt of docs, which were now 3 hours later than promised, and noting that personally I felt $110 was already rock bottom for a double signing, it appeared we no longer had an agreement and perhaps they should find someone else.
I receive a voice mail while I am in my appt stating I was being very unprofessional to pull out at this late hour and of course I am thinking they were unprofessional to lower my fee at that late hour!

They did end up honoring the fee but after several calls from them. The accusatory voice message and then email demanding I call immediately-all while I was in appointment did not make for happy feelings!
And of course you know the seller was inexperienced, there was a trust involved, I was with her 90 minutes while she kept calling her co-trustee brother and the title company sent two revised HUDs.

I did a closing 10/31 and hadn't received payment so contacted Meymax today and they said a check cleared on 11/29. problem is, that check didn't come to me it went to a different notary!
who cashes a check for a job they didn't do?
yes, we confirmed its my stamp on the recorded DOT.

I received the following email Tues morning that I suspected was spam. I tried emailing Riley 2 times inquiring if it was legitimate or spam but got no response.

Finally reached her on the phone just now and she confirmed her email had been hacked and to not open the link.
I am disturbed that True Concept has not contacted me and likely others to inform of the security risk, so I am posting here.

can be dangerous, especially when leaving a brightly lit home to go to your car.
A few years ago I ran into a trailer hitch and tore open a inch size gash on my shin. Took two rounds of antibiotics to cure the skin infection! I now have mini flashlights in the car and in my bag.

"Supplier shall not hire notary and signing agent subcontractors who have not either obtained certification by the National Notary Association (“NNA”) or have had a successful background check by the Supplier using materially similar criteria as the NNA screening process. If the NNA changes its screening criteria from those in effect on the date hereof as, shown on its website at www.nationalnotary.org, or if applicable law or regulations so require, JPMC may amend this requirement, provided however that JPMC shall not require that Supplier amend its acts or practices on a retroactive basis, except as required by NNA or applicable law or regulation."

Fidelity Release and background check update

I spoke with the company that completes the background check for the NNA. They do not release the report to ANYONE, not even the NNA, nor can they do so legally. All the NNA gets is the certificate.

the only way Fidelity would get your personal information would be if you personally sent them your report, provided them your SS#, etc.

Disputed a "defect report" from Title Source

I get this email today that says borrowers check was off by 9 cents.
Being the ex-banker that I am, I am guessing someone transposed numbers. the document posted on the web site is so tiny I can't read it and they don't include copy of the check so I call. The very nice TS rep said indeed the check was short 9 cents. She was apologetic that is was reported as defect but its required. No error too small evidently.

So I decide to dispute because Oregon notaries, according to all TS instructions, are NOT TO HANDLE FUNDS! I know of no other company that interprets Oregon law this way but it doesn't matter to me, I just do what they instruct. I asked the borrower if his check was for $xxx.xx and he said yes and he sealed in envelope, writes name across seal and I enclose in the package. One could certainly argue that I should have the borrower show me the check and not trust him to read the amount correctly, which I will be doing in the future btw Smile

Supposedly TS will let me know when the dispute has been addressed. however, just now while finishing one of the nifty trainings I checked out my defect tab and low and behold I no longer have any defects. vindication!

also, thankful they did not ask me to go collect another check for the 9 cents Smile

SNOW Do's and Don'ts

We are expecting to get 3" of snow tomorrow (I know that is minuscule for many of you in snow states!!). Have not heard when it is expected to hit here. I have a closing scheduled at 1 pm and an hour drive away.

We do get snow, though not every year. Fortunately I have not had to deal with going out in it before (i.e. low amount of snow or not appointment scheduled). I do not carry chains and do not have 4-wheel drive.

My goal is to attend the closing. I am wondering, however, how the ss/lender/title people feel if I wake up to mass snow and don't feel comfortable driving in it? I absolutely hate turning work back and have only done it a couple of times because of laryngitis or the flu. Never for wether conditions.

Would love your feedback. I know I have to decide myself if it is safe or not to be driving.

Closing for next door neighbor

I just received the confirmation for a closing (a week away) that happens to be for my next door neighbor. We are on good terms with him. He is a contractor and has given advice on several of our household projects and we attended a party at his home once.

My quandary is whether or not any of you have done closings for your neighbors. These docs have such personal info on them. I'm wondering if he would feel uncomfortable with the info in my hands.

I am guessing your advice will be to use my best judgement or to call and ask the neighbor if he feels okay with me doing it. I, personally, am fine with doing it.

(I did check the orange button but nothing helpful that I saw)

THANK YOU to all who posted (#479466) regarding this deadbeat company. They have called me twice in as many days. Nothing in Signing Central, but plenty under Forum to make me ignore these people.

The number they called from is 864-916-1111 if that should help anyone trying to collect money from these people.

I'll preface my question by saying I did searches via the orange button but it still didn't quite give me the satisfaction I wanted:

We obviously do not see the HUD and Itemization of Fees docs until AFTER we have agreed on a fee. When we get those docs to print out, it shows: "Notary Fee $150 to (name) Title Insurance Company." I was hired by (name) Lender Services for $1XX.

Can we not go back to the hiring party at that point and ask for the higher fee based on what the docs say, or AM I TOTALLY OUT OF MY MIND HERE????!!!



 
 
Need Urgent Advice!

On August 30 I closed a short sale for a property in California. I notarized two of the four sellers here in Oregon. The other two sellers signed in counterpart with a California notary. All four sellers are related. The package was 250 pages!

I missed stamping one of the docs!! (My worst nightmare!!) The cert was filled out per normal but I missed putting my stamp on it. I make no excuses.

The title co is asking that I now fill out a loose leaf acknowledgement complete with my signature and stamp, and send it to them. I can do that.

My concern is how I should DATE the loose-leaf ACK. Is it going to affect the sale if I date the new cert with today's date????????? Or is this a case where I can back-date the new cert to August 30 and they will match it with the cert they have in possession which has all but the stamp in place???

On a Sunday in June I accepted a GNW appointment from an attorney that called me from a distant city. He was preparing six pleadings for his client (who lived near me) and would e-mail them to her when completed. I would then be notified to drive to his clients location and notarize them. Although it turned out to be a late night (after midnight) by the time it all was finished, I did the job willingly.

I 'dogged' him for payment (invoiced twice and called twice). I got promises of payment at first but never received them. Then he stopped answering my calls.

Finally, from the advice (and wording) of several notaries here on NOT/ROT, I sent him a collection letter a week ago. The letter stated details of the signing and my unsuccessful attempts to collect the fee. I used verbiage from previous posts by PegiT of MN and LKT/CA: "You hired me to perform a notary task for you and you have failed to pay me for services rendered. This is a breach of contract and financial responsibility. If payment is not received in fully by _______ I will send a copy of this letter to the Oregon Bar Association as well as the County Attorney/Prosecutor's office." I added my own: "In addition I will author this information on all major notary sites."

I was already contemplating my next step of Small Claims Court and the possibility of never seeing the money when his payment arrive in yesterdays mail!!!!!!!! Needless to say I have been giddy ever since!!

Just saying, this worked for me and I hope it does for you as well.

Las Thursday I received an e-mail from the State of Oregon people providing the "Revised Uniform Law on Notarial Acts" which takes effect September 3, 2013. (http://www.filinginoregon.com/pages/notary_news/notary-law-changes.html)

I have not read through all the pages yet, but one bit of info did catch my eye:

On page 3, Section 6. Identification of individual.
(2) A notarial officer has satisfactory evidence of the identity of an individual appearing before the officer if the officer can identify the individual:
(a) By means of:
(A) A United States passport or an officially recognized passport of a foreign country or a driver license or identification card issued under ORS 807.400 or a comparable provision in another state, (and this is where it gets interesting, to put it lightly!!) "that is current or that expired not more than three years before performance of the notarial act; . . .

I have read it over and over to make sure I am understanding it correctly. It appears that we will be able to accept EXPIRED passports and DL's (those that expired within the past three years).

Please correct me if I am wrong.

Did a closing yesterday evening for an elderly gentleman who asked if I had ever heard of "Smokey Stover." I had not.

Apparently Smokey was a daily cartoon about a notary that ran from 1935 to 1973!!!

I did a search and found an interesting article about it on Wikipedia!!!
