I tried to explain briefly what the hoopla has been about. She called me because of my profile on one of the sites, and is aware that I am highly experienced. She didn't call back, so I can only assume that FNF wouldn't allow me to do that.
I think that's absolutely ridiculous for them to control our business here in VA.
This wasn't a loan signing either, just the Deed transferring ownership.
It burns me that they have assumed so much control of our business. |

When I arrived I realized the borrower was elderly & confused, but before we got very far he told me he had Alzheimers & showed me his medication. I called the LO & explained the situation. He asked if the wife was competent (not much better than he was) & about the daughter who has POA. The gentlemen said he wasn't talking to his daughter right now over a disagreement. Sad situation with those with Alzheimers.
Needless to say, I explained to the LO that there was no way this could be completed, and he accepted that.
This poor man insisted that he wanted to give me more money that the co. was paying me (another red flag for Alzheimers). I didn't accept it, of course. |

When I come out--guess what--my car's gone! It was upsetting to the borrowers & me, of course. They tried to call their management co.--after hrs., of course. I had arrived at 6:55 for a 7:00 signing. I noticed later on the towing co's. record that they had towed at 7:05. Ridiculous, right???? It cost me $145 to get my car released from the towing co. They didn't bother to knock on the door. Also, my phone no. is on the back window of my vehicle!
These cos. are horrible--they are "repo man" and have no respect for anyone. Fortunately, the borrower drove me to get my car. We'll be in touch with the management co. tomorrow & I think I'll even get an attorney.

I replied with my feedback about that, and was told I could hold off for now, but could potentially be put on a "B" list for those lenders insisting on NNA credentials.
This makes me furious. The market is in a downward spiral, and NNA has been actively marketing it's wares to the tc's & lenders, convincing them they're the only show in town.
IMO this is just about insuring their own profit margin in a declining market.
I have my bgc from here on NR, and will only go the NNA route if I'm absolutely forced to. I've been down that road before & I didn't enjoy the trip. |

Posted by MW/VA at 9/7/2013 7:20:00 PM | I've been doing a lot of work for in the last few months, stating that they are requiring all notaries to get a VA TPL. I've always had my interpretation on this. The law states that notaries aren't allowed to "handle funds".
I called a gal at a local tc that I've done work for to get her take on this. She also said it doesn't apply to us. It requires 16 hrs. of classroom time, take the exam, be sponsored by a tc, get bonded etc.
So, the bottom line is that I'd need to invest a lot of time & about $1,000 in order to collect check that are in the tc's name.
Many of us have always stood on the fact that we think this is a misinterpretation about "handling funds". We aren't acting as settlement agents, depositing funds, disbursing funds, etc.
I've been in biz for almost 8 years, and this has come up from time to time. I do know of some notaries that ask for a separate shipping label & pkg. to have the borrowers send their checks separately so they aren't touching them.
I think the biggest issue is that we're not bonded in VA as notaries & cannot obtain a bond.
Sad part in all this is that I'm sure I will loose my best client. |

The plan is designed to help stop foreclosures, and an investment firm, Mortgage Resolution Partners is involved. IMO someone has gotten really creative in this concept.

This is 30 minutes to drive, park, meet doctor in hospital complex; then, sign; then, ideally, would like shipped back out tomorrow, meaning add 15 minutes of extra driving because I'd have to take to FedEx at the airport, out of my way home!
Countered with my fee..."will get it approved". Then another call...oops...no...we're emailing. Me: add to fee.
Docs were emailed to me, but no order. I send email: "Received docs, but no order. Please send order at agreed fee of *." Get back email: ignore this order, it's being "handled".
Trust me, I'm embarrassed to say I cut my fee quote on this more than I should have, and still...
I know it's not Marilyn taking these ridiculous fees in my area: we know we are worth more than minimum wage!
