Re Sale of Property in SC
I'm doing a signing for the sale of property in SC (estate sale). I know that SC is witness state and requires 2 witnesses of which 1 can be the notary. The executor of the estate says there doesn't appear to be any place for witnesses to sign.
Are witnesses not required for sale of property?

This is one of those situations where many on the board will chime in with their interpretation of the situation. The correct answer will come from the TC.

I just called the seller to have her check with Title Co. and it's NC not SC. Not a problem.

Your lucky it isn't SC. They require an attorney to be on the phone during the entire closing, no matter what state the signing occurs in. Otherwise the TC's get hit with UPL by the SCBAR. They are really cracking down on it too. I do about 1 SC closing a month here in NC.

You follow your state's laws, in other words wherever the docs are signed is governed by that state's laws.

The laws of the state where the deed is being recorded has jurisdiction in some matters, witness requirements is one of them. I did a Grant deed for FL and PAW and Sylvia helpped me with it. CA is not a witness state, but I needed 2 for FL in order for it to record.

Barbara...the info I got was from the attny, Andy at the dept of consumer affairs of SC and an SC notary....go figr. I did find out that the sc notary cannot do a purchase, only re-fi
