MD Notary Fee to increase to $3 on Oct 1. (oh wooppee!)

Section 18-112
Annotated Code of Maryland
(2004 Replacement Volume and 2007 Supplement)

18-112

(a) The Secretary of State shall adopt regulations to establish fees, not to exceed $3 for an original notarial act, and an appropriate lesser amount for the repetition of that original notarial act or to make a copy of the matter addressed by that original notarial act.

(b) A notary public may charge 19 cents per mile, or a higher amount set by regulation of the Secretary of State, and a fee not to exceed $5, as compensation for travel required for the performance of a notarial act.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take effect October 1, 2008.

Where did you find this information? It's not in the Annotated Code of Maryland. The same fee of $2 is listed there.

Senate Bill 4 failed. That is the bill I was talking about yesterday. Click on the link, then move your mouse over the red circle. It states failed legislation. The governor did not sign it.

That happens a lot. People read a bill, see a date it is to take effect, and do not check to see if the bill failed legislation or not.

Shame for MD notaries that this bill failed.

the copy sylvia attached and my copy both say that this Act shall take effect Oct 1, 2008.
The way this reads the bill eventually passed or at least this part passed.

The bill passed the senate but did not pass the house. It never even got to the govenor. Just because the bill says it would take effect Oct. 1 does not mean it became law. It WOULD have taken effect in Oct had the bill became law.

Hey, that would be 3x what we can charge in MN and 6x what Wisconsinites can charge.

But I would have voted against this bill solely due to the 19 cents a mile + $5 limitation on travel fees charged. I'm sure your local air conditioner repair guy won't come to your house for that amount. 19 cents a mile isn't even gas money anymore - and I guess the extra $5 is supposed to compensate for your time spent travelling and wear and tear on your vehicle even if it's a 60 mile RT. Apparently whoever wrote this bill feels notaries aren't even entitled to minimum wage.

The law is written as 19 cents a mile +$5 travel fee OR a higher amount set by regulation of the Secretary of State. Currently we are allowed to charge 31 cents a mile +$5 travel fee.

In order to end the speculation I have sent an email to Senator Simonaire's office for a final determination. If this bill has not passed than I need to let a certain instructor know because she is telling everyone to start charging more come Oct 1 and she is supposed to be on some legislative committee and know the facts.

It's not speculation as far as I'm concerned. I don't care what some instructor said, I can read. Right there on the legislative website, which was linked, it clearly states SB4 was failed legislation. Unless there is some other bill that passed, there is not going to be a fee increase this year.

They increased the fee to $5 in VA. That really comes in handy at tax time. This state also doesn't have any regulations on what fees we can charge in the loan signing arena.
Fees charged as a NSA involve much more than notarization & travel.

Are there any states which limit what someone can charge for services other than notarizations and travel at a closing? Maryland doesn't.

This whole thread has to do with the raising of the statutory fees for notarizations. Not being an NSA.

WDMD Correct - Bill did not pass

I recieved a email from Senator Simonaire's office. I have passed this information on to my CE instructor before she passes this along any further.
My apologies to all of you for jumping the gun and not checking this information out myself before passing it on. I promise to be more careful in the future.,
