BOA loan mod docs from NREIS
I don't know how many of you have seen the new docs, but they DO need to be notarized. You need to sign and date the sig page and add an acknowledgement. These instructions are not in the preclosing package, but need to be!

Shoshana ... Are you saying that the signing agent needs to sign and date the signature page and also add a lose acknowledgment? Are there instructions somewhere stating that an acknowledgment needs to be added?

Yes, that's what I am saying. If you have ever done those loan mods before, you know that prior to these new docs you had to notarize the doc called note and security instrument. Now it's called Home Affordable Modification Agreement. When I got home, I emailed Cindy Scerba from NREIS. She emailed me back that we have to sign on the sig page where it says "By" and put the date on the line underneath. We also have to add a loose Ack. It does not say anything about this in the preclosing package. They have not updated that yet.

Now, I'm confused. My verbal instructions were to
simply attach a blank ack. Did not write anything on doc . Bwrs signed and dated two copies. Third copy was left with bwr. Sent it in a few days ago, and have not heard back.

Let me clarify. I filled in a blank ack form that
specifically identified the document that was signed by the bwrs. I have a form that I use which identifies the document being acknowledged by title, date, # of pages , etc. The mod agreement did not have ack language, but needed to have one in order for it to be in recordable form. Dox were sent to the bwrs, so if I did not attach an ack, there would have been no reason for me to see the bwrs. I had to speak to the company as there were no shipping instructions included. Told them what I did (only logical way to proceed) and was told that that what I was expected to do.

Who gave you the verbal instructions?
I am a more visual person. Besides, my hearing is not too good any more. Sometimes I miss things. Did you really attach a blank ack?

I'm assuming that it's an ack that belongs to a specific document that rquired notarization that either had incorrect verbiage or no verbiage at all, so an all purpose acknowledgment (not a blank one) was attached. I've always had to replace the ack's (usually two) for their modifications, but never signed anywhere else. I'll be very curious to see about that last part. I have one on Monday, but hadn't seen any for a while. I appreciate the heads up.

Janet, I'd love to hear what instructions you get. If it's the same as Bob's I'll go back to this person and ask her about this again! Also, what's interesting is that even though the docs are supposed to be emailed to the notary, many times they are overnighted to the borrower anyway. So, check with the borrower before you print them out! Shoshana
