Now that the question of a 1099 is brought up. I have a question. If i'm a corporation and all checks are made out to my company, should I have been 1099'd from a SS? I called and questioned being 1099'd. Exact conversation I had. Why did you 1099 me? Smart A$$ answer "because I paid you". Am i wrong? Appreciate any help.

Re: Get it signed _ If I understand your question the
SS paid your company, a legal person, and not you. How you take your money out of your company is of no concern of the SS. Did you supply you EIN to the SS? Did you enter into the agreement to sign as a person or as a principal of your company? Disclaimer: I am not an attorney and this is just my personal and totally unqualified opinion. To get a qualified opinion you should contact an attorney.

Re: Get it signed _ If I understand your question the
LOL on your disclaimer. Yes to providing an EIN. Yes to being paid as a principal of my company.
I guess whoever does my taxes will take care of that. Just wanted to be sure I had the correct information.
Thanks for your reply.

The IRS is trying to close in on reporting income. It's rumored that companies will be required to send 1099's even if they paid you a dollar. From their accounting side they will issue the 1099. As a Corp. it will be up to you at your end for how the income is reported. I got 1099's this year from companies where I was paid on the HUD & wasn't expecting that income to be reported on 1099. I was mainly concerned about where I needed to report that income. My concerns were resolved, because I was able to link the 1099's to the Schedule C.

Again, TY for your response. This company is "the only" one who has 1099'd me. Any advice is appreciated.

If the tax laws are the same as when I did my own taxes (I now have an accountant do them as they became too complicated for me) they have to 1099 you if they paid you anything over $600. It does not matter if they 1099 you or your company (unless you are not the only owner or maybe in other corp situations??) it all gets tied to your SS# on your personal taxes.

It gets reported to the IRS under your SS or EIN, but is NOT necessarily reported on Line 21 of the 1040 (other income). As I said above, Turbo Tax had a provision to "link" each 1099 to my business on Schedule C.

Re: Exactly
well all I know is that I got a 1099 that was inflated by hundreds and on top of it the SS never paid me a dollar..just a nice little e mail that thanked me for all my hard work but they were going out of business..what, now you think I'm going to pay your taxes too..those loans closed and that signing service recieved there funds..I know I'm ranting but Heather Murphy of" Get it Signed" can shove it were the sun don't shine!!! O.K....I feel better now

Re: Exactly
Absolutely report it to the IRS. You don't want to have to claim income you never received. What gall--a deadbeat trying to report money they never paid out! Go get 'em!

You have to call whoever sent the 1099 and have them prepare a corrected 1099 and file it with the IRS, ohterwise the IRS will want to see that income reported on a separate schedule C and it is going to be more frustrating for you to straghten it up. If you provided an EIN no and your corporation name and address on the W9, they should not issue a 1099 to you as an individual, period. The only corporations that are receiving 1099s are the Attorneys

I would talk to whoever does your taxes. I just talked with my accountant about one I received that was inflated (although I requested a new one and did not receive it) and he said he would just adjust the 1099 with the income I report and it would wash out. I am sure all your income is more then the 1099 amounts you recieved(income with no 1099 sent).
Yes, I believe there was or is a exception that if you are a corp. they do not have to send you a 1099, but can if they want. Why the fuss anyway about receiving a 1099 if they paid you? As I said above, you probably earned way over the amount reported on that one 1099 anyway. If you got into this business thinking that all earnings are tax free, you are wrong!

Hi Heather,
Did you got a regular 1099 first? Any company or person should issue 1099misc if they pay you over $600 in a year (some companies issue one even if they pay you less). and yes, your tax advisor will transfer the info to your schedule C.
you can find more info under irs.gov/business
Hope this help

The point is not about me paying my taxes..I'm not an idiot...yeah I could just use this 1099 but the point is..they already ripped me off and now they want to offset their income by having me pay therir taxes...not going to happen on my watch!!!

Re: Get it signed IRS contacted
Was told that if I feel fraud is involved that I fill out form 3949-A...was told NOT to use the 1099 sent to me...only report income that was recieved from this company...zero..it probably would be easier just to report it so no letters or audits come my way but frankly I am so done with these companies...whats that line..oh yeah..I'm mad as hell and I'm not going to take it anymore..(hopefully)

Re: It sure can get confusing when you have two different
conversations going in one thread. CT my thought about not paying taxes was about A-1s gripe with getting a 1099, was not about your situation.

CT, I would report any income that you did receive and be sure to keep any correspondence between you and the other party. To cover yourself further, I would send a letter to your IRS service center in Fresno, stating all the facts and enclosing copies of any correspondence requesting that the SS correct the "error."
