Is there any state in which this is legal?

I suspect this may ultimately actually be the norm, maybe 20-25 years from now. But for right now, it seems the technology is outrunning the law.

I dunno... I realize that you don't do thumbprints in Texas, but it's required for many things here, and probably elsewhere. Right now. that would be pretty tough to do! Of course, someone will probably figure out a way to get a thumbprint electronically, too, but it seems to me that that would be too easy to fake.

YOu can do electronic thumbprints in CA. I know several notaries who maintain electronic journals, complete with a electronic signing and fingerprint pad. That's perfectly acceptable in CA... just few do it. The ones I know that do are stationary notaries, too...not mobile.

There's no way that I can think of that this could be done remotely.

get electronic thumb prints.

Texas notaries are not supposed to collect "biometric" identifiers. According to the SoS, that is exactly what it is.

If this website is left to stand, I would like to partner with someone who wants to sell marijuana over the internet; or perhaps forged documents. I mean, if the internet is like the wild west, let's make it good.

Good point. But I *was* visualizing the remote aspect of sending it over the internet in some fashion. I think it would be pretty difficult to pick out fake IDs, too. But I guess, as others have discussed, that's not really worth much contemplation since personal appearance will probably continue to be a requirement for a very long time.

Like Lisa said, I wonder how many unaware consumers will be drawn into this. And I wonder how much they'll charge for closings ;-)

Glad to see the SOSs taking interest in this matter

This is very dangerous to our profession. All we need is for other notaries to see this and start a similar website. Not to mention, the public will begin to think that personal appearance no longer applies.

I spoke with the CA SoS office...

They are now very aware of this. This company seems to be based in California on some level, as their press release is out of Newport Beach and their contact phone number is area code 805 (also California).

The gentleman I spoke with took down all the details and said that it was, in fact, illegal, and he'd be forwarding it to their investigations department.

OH, and something interesting. ON their website, they state that they way they verify identity is not just by ID, but by utilizing details from credit files! Uhh......

I am impressed. I called a few times and was put on "forever hold" . I filled out the electronic form on the website.


I guess they didn't know it was me on the other end, that's it!! Smile

Hadn't heard of "forever hold" but have heard of Perma Hold. Must be the same. It's a bear trap one cannot get out of sometimes. Stinks.

I've always called it "terminal" hold. Seems to cover the prognosis of being stuck there "forever"...
