Accurate National Signings?

This company has called me several times but they appear to have a bad history of paying. And there is this....5/20/2013 See Riverside (CA) Superior Court Case #RIF152923. I can't seem to find how to get access to that case. Does anyone know what that is all about?

Since you asked, NC, here it is. Expungement hearing on May 17 was successful...the dirty deeds don't disappear, only from public view. The DOJ/FBI background check will always reveal this information, forever. It's a band aid. Hard to believe you can be convicted of ID fraud and forgery and be in this biz. Only in CA!

... as far as I can tell she's already violated Condition 1:

and ours? This is insane. I just don't understand how "IF" lenders and TC's are adhering to all the privacy protections how they have these middle people known as SS's handling their business. I must be missing something here. Isn't there some Federal or State Agency that would be concerned with the protection of consumers information? What about the FTC

The Gramm-Leach-Bliley Act, which requires financial institutions to ensure the security and confidentiality of customer information, provide notice to consumers about their information practices, and give consumers an opportunity to direct that their personal information not be shared with certain non-affiliated third parties. Which brings me to the privacy statements in the lender and TC packages, none of which I recall saying that their information is being shared with a third party SS or us for that matter.

Oh, it's still public record...

It doesn't even disappear from public view. The court case is still a matter of public record and would show up on any background check.

What happened here is that this person was convicted and sentenced. The sentenced included 3 years of probation. Probation was completed back in March, and this person filed a request for a dismissal/expungement, which was successful, just this month. Expungement means that, legally, the conviction goes away. But, the record of what happened does not. While this person can legally claim no convictions for SOME things, it won't help for others.

Let's say this person wanted to apply for a CA notary commission. Even if it is expunged, it would have to be noted on the application. Plus, as Stoli notes, it would always show up on a DOJ/FBI background check. See: http://www.saclaw.lib.ca.us/pages/expunging-criminal-records.aspx for some information, especially regarding what expungement does and does not do.

I think the more important idea, here, is that this person, who is part owner of a signing service (per: Msg #462242 ), obviously has/had some aspect of access to borrower's loan documents as well as notary payment information.

My question is this, as others asked before, too... do these title/escrow companies and lenders, who have become so anal retentive about making sure the notary have a background check done... bother to screen the signing services (and their personnel)? Do they know if an owner of a service is a convicted criminal or on probation? Or as now in this case... has a dismissed criminal history after service a jail/monitoring sentence plus 3 years probation... for a case involving identity theft?

How many borrowers out there would appreciate knowing that, at some point, their documents were accessible by somebody on probation for identity theft offenses. Of course, said person is no longer on probation and has had her record dismissed/expunged (as of this month) --- but as the link above points out... said record does NOT:

"1. Remove the conviction from your criminal history. California and FBI criminal history records will still show the conviction and the subsequent dismissal.
and

2. Seal the court case file from public inspection. The court file remains public record."

Also... for those wondering if this person could obtain a notary commission? Well... not in CA.... not for at least 5 years, if ever.

Per the disciplinary guidelines published by the Sec of State:

“All convictions must be disclosed, regardless of when or where they occurred, including convictions that have been dismissed or expunged under Penal Code sections 1203.4 or 1203.4a. The only exceptions are traffic infractions, offenses adjudicated in a juvenile court or under a youthful offender law, and any incident that has been sealed under Welfare and Institutions Code section 781 or Penal Code section 1203.45 (juvenile offenses).” (page 9)

and continuing on pages 10-11:

“In the case of a conviction for a lesser offense involving moral turpitude or incompatible with the duties of a notary public, the passage of not less than five (5) years since the completion of probation or parole or, if probation or parole was not ordered, then release from incarceration.”

Now, considering the nature of the offense (identity theft related)... there's no guarantee they would even give her a commission anyway, even after those 5 years. That's an individual thing. My guess is... not bloody likely.

Carol... according to her LinkedIn page, she's been associated with the company as the 'CEO' since August of last year... at which point, according to the to public records as they are listed, she was still on probation and making fine payments. She was sentenced to 3 years probation, among other things as you can read on Soli's notes above.

Who is/where is Docgirl...we need to hear from you. Why are you hiding? And who is Sara in all of this? The CFO? But wait, aren't there four owners of the company, although only Jason and Amanda are on the DBA Fictitious Business Name Statement. Is there a corporation at all? Wasn't it Amanda who posted earlier this year she wanted to "RATE THE NOTARIES"? My, my, my, Amanda. Shame on you. Calling the kettle black, ya think?

Didn't I read that Docgirl aka Amanda worked at Docpros down the road for a while before jumping ship and starting her own signing service? How come they didn't do a background check and find out about these convictions for ID fraud and forgery before they hired her? Wow! Who can you trust, not that they are a much better paying company than Accurate. Seems to be two identical business models, don't pay the notaries until they squeal for their money, 45 business days and more later, if at all. There are notaries who have never been paid, if you look at the ratings, from September 2012.

So do your clients, title, escrow and lender, Amanda, know about your convictions for ID fraud and forgery? I'll bet not. Shocking revelation. Seems like you don't have to be very honest or professional to get into this business. Are all the notaries are finally getting paid at least?

This company has not had good ratings from the get go, if you look at the no's site. We didn't catch on for months after ANS opened their doors because they weren't in SC. This all seems a bit shady. We as notaries must maintain a clean background and not commit any issues of moral turpitude and here you come with a full Monty of id fraud and forgery charges on your record and yet have privy to people's personal information and financial data, as well as notaries' social security numbers. Staggering to imagine how this could happen!

What do you have to say for yourself, Amanda, Docgirl, Sara, whoever you are? Speak to us! Come out of hiding!

Hello! This is just my end of the month reminder to let you know that I expect to receive payment for this closing by 05/15/2013. That is the 45 day mark, and it is my policy to call the Title/Escrow office (xxxxxxx in this case) the lender (xxxxxxx) and the Borrowers (xxxxxxx) if I do not receive payment on time. This policy is not exclusive to your company, but it is part of how I run my business to keep from having to chase down my compensation for the work that I do. Thanks for your cooperation in this matter, and I hope you're staying busy,

Hello esnotary,

Our payment policy which is outlined in our policy and procedures that you signed and emailed back to us show 30-45 Business days. Plus there is no other party that is responsible for paying you except ours. Contacting the borrower involves a party that has nothing to do with paying you at all and after you meet with them to do their loan closing you are not permitted to contact them in regards to this matter again, this is information from the SOS.

Also before going too far into things, here is how this works. You can pull all the information you would like off the docs, that is a violation of the

Gramm–Leach–Bliley Act. You are hired by our company to do a job we are the only ones that are responsible to pay you for these duties. Contacting the Lender, title or any other party involved is a violation of our sole proprietor contract with our venders (yourself) ( All of the mentioned minus the borrower is in receipt of our vender agreement and are aware of what our policy is.


Thank you and your payment will be paid as soon as it is processed. Thank you

Well, you know the answer to that, Carol! NO.

Her response is an absolute masterpiece of initimidation and falsehoods. I have ever seen such lies since Clinton said he "never had sex with that woman."

It gives us great insight into the type of person she is and how she operates and has operated .... her criminal tendencies .. the type of crimes she committted and whom she committed it against.

I suspect a few week-kneed brainless NSAs might fall for her pile of BS. But I've got to hand it to her ... what an imagination! What a full frontal assult against any notary who dared asked to be paid!

Don't know where that other notary is located. However, insofar as CA is concerned, the only directive the SOS makes regarding payment is notary fee maximums and entering the amount in journal. The CA SOS does not concern itself with loans/borrowers. CA SOS recognizes and governs notaries public, not loan signing agents.

Given the history, I find it amusing they mention GLBA!

Hello all,

There is no hiding by anyone here at ANS, have you ever heard of none of your business? A personal issue that occurred and you do not have all the facts DOES NOT mean any of you have the right to judge and prosecute a person on a stake. I am sure in your days of being a human being you have all had a finger pointed in your direction that was incorrect. We do not have to comment on a forum that is nothing but negativity and badmouthing by so called professionals. Please reevaluate yourselves, what you decide to talk about on a notary help forum and understand that many times there is called false convictions and the good people paying for another persons misconduct.

Actually, it's a matter of public record. The facts discussed here were what is available via public access. If the court record is wrong, then the person needs to hire an attorney to correct it. Otherwise, facts are facts... or did this person not get convicted of crimes related to identity theft, serve some time/monitoring and complete 3 years probation before filing for a dismissal this month?

Or... are all of the reports of slow and no pay from hundreds of notaries also wrong?

But was there active disclosure? We, as notaries (especially in CA) have to submit to numerous invasive background checks and have to disclose everything about our criminal histories. It's a sensitive issue to be sure, but we all put up with it. I would like to know if the lenders you're dealing with knew one of the owners of your company was serving probation for identity theft related issues until recently and knowingly supplied you work having this information. You are working in an industry with NOTARIES and one of the primaries of your company had been convicted and was actively serving probation on something involving IDENTITY THEFT. DO you not see the issue with that?

The details don't matter. What's been discussed here are the facts from a public record. To say it's none of our business isn't true. As taxpayers, we had to pay for that process that person went through. Any fines she may have paid didn't cover the salaries and time of everyone involved in her 3+ year ordeal.

I can tell you that myself, if I were in the position of a borrower and learned this, I'd be FURIOUS.

Again, if the public record, as it stands, is wrong... then instead of bad mouthing people here, try to get the problem fixed from the source --- the court record. Otherwise, it stands as pretty credible source of information.

But then... as we learned in Shawshank Redemption... "I'm innocent, remember? Just like everybody else here."

From my background in law enforcement and within this industry judgement is made here faster than a man speeding 100 miles an hour in a school zone. Have any of you called this company with your concerns? Have anyone of you taken the time to find out the real facts and not just what is here? A DA's accusations before trial? or after? Have you done any of this? NO none of you have. All that is here is ASSumtions.

How do you know this company has not gone through scrupulous investigating? None of you have any clue what a SS or any larger business has to go through to obtain clients. None of you know what meetings have to be had before a contract is signed to work for a large company. So with this said your assumptions of what a SS has to go through is just like any other business we have to be licensed, bonded a huge E&O policy, pay taxes and many behind the scenes business things.

Thank you for the witch hunt, burning the owner at the stake does not mean this company has to stand for what is being done, we are a professional company and only work with professionals in this industry.

I want all of you that have posted on this forum to state who has and has not worked for this Company! Oh let me do that for you NONE. How many of you shop at your local grocery store and ask them for a background check, credit check because guess what they have your CC number on file now once you swipe it to buy that pack of oh something.

Just remember not all humans are perfect and there are things that no one is proud of in their pasts, the best thing is to get up, move on and change the perception of you by doing good and prospering in this world.

I can assure you that the reason people aren't working for your company aren't because of this new piece of information. It's the months worth of people reporting extremely slow and no payments. It's people (here and on other numerous online forums) reporting how rude you are to people. Plus, let's not forget this: Msg #461997

Your company had little to no credibility here long before now. I'm sorry, but it's true. This only adds to the reasoning behind it and confirms what most of us already knew.

We have thousands of notaries that work for this company, their choice not anyone else's. I work for a great company and I have given a benefit of the doubt to allegations and listened to reason, which it seems like many are not capable of doing.

That is all I have to say, no reason to sit here and defend an issue that is not mine or yours, you have no reason to keep lighting the match to unscrupulous finding of a witch hunt.

The grocery store employees do not have access to the credit card or debit card info swiped.
That is why they use those machines, it bypasses them and is verfiied between bank clearing houses. Why ever would you think that they have your CC on file?

That's what several of us have been trying to emphasize/question for some time now. Why are we working with middlemen companies that may be staffed by people who aren't even eligible to become notaries themselves? What safeguards are in place, if any, to assure people that these background checks are even helpful? I mean, if Lender A is hell bent on only hiring notaries who pass a certain background check to handle their documents... do said lenders also screen the signing services? Do these signing services have hiring and background screening procedures in place that satisfy the same requirements of those placed on the notary?

What's the point of having the notary be background checked if they funnel documents through companies/people that are NOT... and as this case illustrates... potentially right through the hands of somebody serving probation on an identity theft conviction.

From what I recall from previous post; at least one owner of this company is a notary? I'm lumping "all" supposedly (4) owners together and more than likely the person posting is in fact a notary.

The point for mentioning the "notary aspect" of my comment, however, is due to the ludicrous SOS decision as it is begging for people to be put in harms way dealing with this type of character who owns ANS.

Was in Wildomar last week and went by ANS or at least the address. They are no longer there and I am assuming they have closed shop. I have been trying to reach them for 2 months to get paid for a signing I did for them in May.
