Notary surety bond

A notary surety bond protects the public from mistakes you make while performing your notarial duties during the term of your commission that result in damage to the public. The three parties to a surety bond are the principal (the notary), the surety and the obligee. When a claim is made against a bond, the claim is investigated and, if proven valid, the surety will pay the obligee the amount of the claim subject to the bond's limit. The surety may then seek to recover the amount of the paid claim from the principal. In this way, the damaged party (the public) has been compensated, while the notary is ultimately responsible for paying for the mistake.

62.050 Bonds, when to be given.
  1. Except as otherwise provided by statute, no officer required by law to give bond shall enter upon the duties of his office until he gives the bond.
  2. Except as otherwise provided by statute, each person elected to an office who is required to give bond shall give the bond on or before the day the term of office to which he has been elected begins.
  3. Each person appointed to an office who is required to give bond shall give the bond within thirty (30) days after he receives notice of his appointment.
