I have a closing at noon today......40 minutes away.......and it's negative 8 degrees here. I have called the borrower's telephone number to confirm and someone answered and then hung up on me when I asked for her. Now when I called back it sounds like children are answering and screaming in the telephone, giggling, and hanging up. I called a few times and that is what happened. Now I called again and it rings four times and goes to voice mail. I texted and no response. Should I just suck it up, bundle up real good, drive the 40 minutes to her house and hope she answers the door? Docs are printed. What would you do?

......and it's going to be even worse tomorrow they say. Not only is it cold out, but the few inches of snow we got earlier in the week has turned into solid sheets of ice on some roads and of course driveways, sidewalks, and front porches.

Alert: Accurate National Signings Criminal Proceedings

I just want to update my fellow notaries on the latest news regarding Jason & Amanda Kirkish and Accurate National Signings. It has been brought to my attention today that they have filed bankruptcy, obviously trying to beat the legal system and avoid paying notaries for their work doing signings for this now defunct company.

I want all notaries to be aware of the fact that the Riverside County California District Attorney's office is continuing in their investigation of these people and any notary that is owed money by them needs to contact the County Attorney's office and file the necessary paperwork.

It has also been brought to my attention that just because Jason & Amanda have filed bankruptcy, it does not mean that they will succeed in receiving a discharge. The judge is the one that will make that decision based on the information that is given to them. If it appears that Jason & Amanda purposely did not pay notaries for their services, and spent the money on lavish trips, breast augmentation surgery, etc., there will be no discharge and the debts and judgments will remain.

If you or anyone you know is owed money by this company, please contact the Riverside California County Attorney's office at 951-955-5400.

Government Shutdown Will Cripple Our Business

Not only will there be no FHA or VA loans being processed, the government shutdown will cripple the conventiontional refinance market as well because although the IRS will remain open, they will not be processing any 4506-T requests at this time.
 
 
Plagiarized Notary Profile....Definitely a Big No No!

Just a little word of advice.....especially to the newbies. Please do not plagiarize a fellow members notary profile just because you are either not smart enough to come up with a professional description of the services you offer on your own, or you are just plain lazy and think that by copying word for word another member's profile it will generate telephone calls for you. I am here to tell you that you are sadly mistaken, especially when the notary profile you copied is that of a notary who lives only a few blocks from you and is very aware of who her competition is. The only telephone call you will be receiving is the one from the notary who's profile you plagiarized telling you to change it.

CBS News Just Reporting That Feds Will Keep Rates Low

Ben Bernanke wants to keep interest rates low and the government needs to keep stimulus packages in effect because economy has not improved enough. He stated that "What we are going to do is the right thing for the economy."

ALERT: Accurate National Signings Criminal Proceedings

I have a very important announcement to make to any and all notaries that were bilked out of their money by Amanda Marie Kirkish of the now defunct Accurate National Signings formerly known as Accurate Signing Service of Lake Elsinore and Wildomar, California.

I have spoken to the legal team of ValuAmerica and have been told that they have a list of at least 30 notaries that have not been paid by Amanda Kirkish and the calls keep coming in every day. They have come to the realization that Amanda was not truthful about her very public criminal past when signing up with them for their business. If you are owed money by this company, please contact ValuAmerica and let them know.

I have also been in touch with the Riverside County California District Attorney's office and have told them exactly what Amanda Marie Kirkish has done by gaining business from ValuAmerica and hiring notaries throughout the country to close loans for her and then not paying them. She has claimed that ValuAmerica has not paid her, but ValueAmerica has proof that she was paid 30 days after the closings. The District Attorney's office is very interested in pursuing criminal proceedings against Amanda Marie Kirkish as she was on probation for theft related charges when she opened this company, she picked a name very similar to another company in California with a good reputation, she lied about her criminal history, and she has a pattern of not paying any of the notaries that she hired to perform a legal transaction.

The DA's office asked that I let everyone know that they are interested in filing criminal proceedings against her but need all notaries that were bilked out of their money to come forward and report this crime. You should go to the District Attorney's website and download the special prosecution complaint form and return it to their office. I have included the links for you.

What Is Your Crystal Ball Telling You?

I'm not sure what to make of this slow down.......no......screeching halt.....to our business. I have a lot of theories but now I am beginning to wonder if it is time to pull the plug on this and start looking for the next big thing......whatever that may be.

I have been in the mortgage business for the past 13 years and I have worked in everything from brokering, loan origination for a large bank, commercial lending for a small bank, underwriting, and now notary signing agent. I have seen mortgage rates go down, up, down to an all time record low, and now back up again. I have seen housing prices rise to unrealistic values only to plummet to all time lows. I have seen foreclosures at an all time high and the government programs that followed to reduce the amount of foreclosures and get the economy jump started again. I have seen big banks lay off entire departments only to hire new employees a month later. I have seen gigantic mortgage companies close their doors completely.

I am a big supporter of President Obama's HARP programs. I was an underwriter in 2008-2009 when this program was first rolled out. It was only supposed to last for one year......and here we are almost five years later and we have come a long way.....but there is still so much left to do.

I see all the positive things HARP has done for the housing market and why I feel that HARP 3.0 needs to be implemented to help the remaining homeowners. This program has allowed people to refinance some of their crappy arm loans and negative amortization loans into fixed rate products. It has lowered the foreclosure rates. It has stabilized the plummeting housing values. It has helped minimalize the rise in rental rates. Homeowners are taking what they are saving on their mortgage and once again feeling comfortable shopping, thus helping the overall economy.

Just because I see all the positive things HARP has done for the housing market and why I feel that HARP 3.0 needs to be implemented, doesn't mean that it will pass. This just might be it folks. The fat lady may have just sung. I have always maintained that the big banks are not going to just stop doing refi's.....that is how they make their money. But now after hearing that Wells Fargo laid off a bunch of people, Citi just laid off a bunch of employees today, title companies are closing, and the talk is HARP 3.0 may never happen.......I'm beginning to wonder how all of this will play out.

I am trying to maintain a positive outlook during this slow time......but my crystal ball is cloudy......and what I am seeing does not look good for any of us.
 
 
Accurate National Signings.....Very Important Information

I have contacted the District Attorney's office in Riverside, California and am filing a complaint so that they can bring fraud and theft by swindle charges against Amanda Marie Kirkish of Accurate National Signings for hiring notaries to perform mortgage loan closings with the intent of not paying them. The fact that this includes transactions out of the state of California could turn this into a federal case.

With her lengthy criminal history, this turns into much more than business has slowed down and I can't afford to pay the notaries. I can prove that she has a criminal history and has been convicted of forgery and grand theft.

If Accurate National Signings owes you money, please take the time to fill out the complaint form for the District Attorney's office and get it sent into them. The more people that come forward, the better our chances are of getting this woman put away behind bars.....which is where she belongs.

OMG......Why Didn't I Read Signing Central?

I am just sick......I have never gotten screwed over......I don't know how this happened. How on earth did I let Accurate National Signings get one over on me? If I would have read Signing Central.....like I am supposed to.......like my fellow notaries have drilled into my thick head over the past three years.......I would have NEVER NEVER NEVER in a million years accepted a job from these criminals......what the heck was I thinking? There have been numerous conversations about this couple and their dirty dealings and it all went right over my head.

Well you live and learn.....but this is not over yet......I am going to make this my mission to get my $100.00 from these folks......or they are going to jail.....that's right.....jail. It appears they have a very lengthy history of hiring notaries and not paying them. Theft by swindle and fraud. Can't wait to call their county prosecutor and get the ball rolling on these deadbeat criminals.
 
 
Receiving Full Payment For A No-Sign Or No-Show

That is correct.....every time you go to a borrower's home and it turns out to be a no-sign, or you go to a signing and the borrowers don't show up, you should still demand your full fee.....and get it......a simple print/trip fee is not acceptable. Don't use this when no docs ever come though......that I would never do.

Over the past three years I have never not been paid for a no-sign/no-show. Title companies and signing companies want to throw you the print/trip fee and I let them know that I was hired to do a job, I printed out two sets of documents, I went to the closing, I presented the documents to the borrower and it is not my fault that they decided not to sign.....or in the case of a no-show......it's not my fault that the borrowers decided not to show up for an appointment that they knew full well they had.

Make sure you let the hiring party know that you were hired to do the job and you fulfilled your obligation to them and you deserve to be paid your full fee. You very well could have turned down business for this appointment and let them know in a professional manner why you deserve to receive your full payment for services rendered.

I will tell you that title companies and signing companies are usually very kind about it when you present yourself professionally and let them know that it is not the dollar amount, but the principal of the matter, and that the lender is the one that made the error and they can afford to pay this extra money.

Signing Today....Borrower Misplaced Drivers License....Help!

Signing today at 5:00 p.m. and borrower has lost her drivers license at the state fair this weekend. The first thing I asked her was if she had a passport....and no she does not have one.

Okay....so what would be an acceptable form of identification I can use for her......and we all know the lender is going to just say it's okay to take any ol' kind of id cuz they want the loan to fund.

I've never had this before.......what should I accept? She says she has a work badge with her picture on it.

Not Sure What To Do Here - Do I Not Go To The Closing?

Good morning everyone. I have a closing in two more hours with a gentleman that I have already confirmed is single. When I printed the documents, however, I noticed that there is a woman's name on the spousal docs. I called the borrower and was informed that "Hilda" is the name of his deceased wife who passed away two years ago. He then informed me that he sent the death certificate to the lender and someone was supposed to be working on this. However, I received docs with her name on them. I tried to contact the hiring party (a title company) but no one is there and no one is answering any of the cell phone numbers listed.

I don't really feel comfortable making the decision on behalf of the lender and the title company, but I am guessing that the proper protocol would be to let the borrower know that we cannot proceed with the closing with the documents that were sent to me and that I am not able to get in contact with anyone because it is the weekend and that his lender will be contacting him with a new closing date once the documents have been corrected.

We can't just cross of her name......so I am hoping that the title company won't be upset with me for not going to the closing. I will e mail the closing coordinator who sent me the docs and let them know what has happened. Is this how you would handle this situation? Any other suggestions?

......and no interpreter was ever set up for him as promised by the lender. Today is not looking so good at this point. First closing is not until 3:00 p.m., so hopefully everything will turn out okay. I am supposed to have four closings.......let's see how many actually happen.

Don't Be Afraid To Insist On Your Full Fee.....

......I had a situation this evening where I went to a closing and the borrower's weren't even home. The lady shows up ten minutes past the signing time and acts surprised that I am sitting in her driveway. I won't bore you with the details that transpired, but I will tell you that I called the telephone numbers on the instructions and explained what happened and was informed that I would receive a trip fee. I said no I would be insisting on receiving my full fee of $xxx as the borrowers clearly knew they had a closing and didn't bother to show up for it or call and cancel. It is EOM day and I turned down other business to take this signing, I printed docs, and I drove 35 minutes to their house. It is only fair that I receive my full fee for this. The lender can build it into the closing costs for the next go round. The title lady agreed with me and said that I should invoice the signing company my full fee and she would approve it.
 
 
He Kicked The Dog

I went to a closing last night and was greeted at the door by two of the most darling fluffy white bichon mix dogs. I proceeded to enter the home and both dogs were barking and wagging their tails and excited that they had company. They were kind of in my way as I tried to enter the kitchen where the signing was about to take place as they were still sniffing me and still a little excited. They never jumped on me though.....just sniffed, barked a little, and wagged their tails. I guess the borrower did not approve of their behavior or something because he took his foot and kicked one of the dogs out of the way. It wasn't a hard kick, and I don't think the sweet dog was phased by it, but it was the fact of the matter all the same......he kicked his dog.........shame on him. It made for a very uncomfortable signing for me the entire time I was in his home. I hated him for what he had just done to such a sweet little doggie and I really wanted to kick him back on behalf of his defenseless little dog.
 
 
My Biggest Pet Peeve Regarding Scheduling...

.....are these companies that send out the mass e mails saying they have a closing in my area. It's like trying to be the first caller into the radio station so you can win some lame tickets to the local pizza joint. I don't participate in those and I am certainly not going to try and knock myself out responding to a mass e mail sent out to every notary in the neighborhood about a closing in my area.

It just so happened that I got one of those e mails today from a company I have signed for in the past. I was sitting at my computer printing out docs for my evening closings and it happened to pop in during that time. I responded within one minute of receiving the e mail and don't you know someone else had already responded before me and got the assignment.

I have enough companies that value me as a notary and they either call me directly, e mail me, or text me in regard to the signing and give me a reasonable amount of time to get back with them. I refuse to jump on the cattle call bandwagon.

 
 
My Suggestions On Dealing With Non Paying Companies

It seems like almost every single day I read about a notary that has not been able to collect their money from a title company or a signing company. It's hard enough being self employed and having to hustle for the business, yet alone having to spend our days trying to collect what is due to us.

I would like to take a moment and offer my suggestions on dealing with non paying companies. So many notaries go to the Better Business Bureau. The BBB is not going to do anything for you in helping you collect your funds. The BBB is a rating system, not a means of collection. They could care less if you get your money or not.

Many notaries try and go straight to the title company and collect funds, if in fact it was a signing company that did not pay them. I am going to tell you right now that the title company is probably already aware of the fact that the signing company is not paying and probably doesn't give a crap. My guess would be that if a title company is using a signing company that has a history of low pay or no pay, it is because they are bottom feeders themselves. Birds of a feather flock together.

Here is how you get your money. You find out who the owner's of the title company or signing company are that you did the work for. You call the County Attorney's office or Prosecutor's office in said county and you report them for theft by swindle. They have hired you to perform a job and are not paying you for services rendered. If they have a history of no pay, then it proves a pattern with this company and the county and state they are located in don't take kindly to companies that are committing fraud and swindling people out of money.

How I know this works is because I made that call and the County Attorney/Prosecutor was very interested in what I had to say. I then contacted the signing company who has a history of not paying their notaries and let them know what kind of legal action the county would be taking against them and I had my check in my hand within five days.

I hope this is helpful for anyone out there that is trying to collect from some of these scum companies out there.
 
 
Service Link Taking Over LSI Call Center in Columbia

I have been signing for Service Link and LSI for the past four years and during that time I have received a lot of telephone calls from the LSI call center that schedules the Chase closings from a Miami telephone number but I know that they are actually calling from Columbia.

Today I received a telephone call from that same Miami phone number and it was one of the regular girls that usually calls me for the Chase closings. She said she had a Chase closing for me on such and such a date and would I be interested in it. I said sure.......and then she said this is with Service Link.

Come to find out some of the agents in that call center are still scheduling for LSI and some of them are now scheduling exclusively for Service Link. This does not surprise me in the least considering the fact that it appears LSI's workload has decreased substantially in the past six months. I keep hearing rumors of lawsuits, buyouts, and now I am seeing that Service Link is taking over their call center with the scheduling of the Chase closings. Not a good sign for LSI at all.

Has anyone else experienced this?
 
 
e-NOTARIES.net Offering $10.00 For Field Inspections

I just received an e mail today from e-NOTARIES.net asking me if I would like to do field inspections for them in my area. The appointment would only take me 10 minutes as it is basically a drive by. I would take seven photos total, fill out a form, and get everything back to e-NOTAIRES.net by the following day. They would like to pay me a whopping $10.00 per inspection. If I am interested in this great business opportunity, all I have to do is let them know and they will make me either the primary or the secondary person for my area.

All I can say is good luck to the idiot that accepts this offer. Next week e-NOTARIES.net will be sending out an e mail for $5.00 per inspection.
