Signing Services - Something Needs to Be Done.....NOW

My recent missive to the NNA:

When is the NNA finally going to make themselves heard regarding the growing problem of criminal activities of certain so-called Signing Services? A lot attention is being devoted to Notaries, with background checks, and scripts, honesty, integrity, etc., yet NOTHING is being suggested re: what to do about people who open and close these "Signing Services," keeping the money paid to them by title, and stiffing notaries nationwide, over and over. Not one iota of regulation exists, yet certain of these criminal enterprises run roughshod over notaries, closing and reopening businesses, constantly cheating the notaries that you champion, notaries who are supposedly such a "crucial part" of the loan signing process, who get ripped off each day. No suggestions by NNA have been evident (that I can determine), regarding needed industry regulation of these sleazy enterprises, as there are no minimum requirements for "signing services". Hundreds of notaries are NOT being paid (ever) for work they have performed, yet a blind eye is turned toward this growing atrocity. It is time NNA put forth cogent input on Signing Services to the industry, much as you do right now to the Signing Professionals Workgroup setting higher standards for Notaries. This "signing service" situation has to come to a stop, and there is no time like right now, in the middle of these reforms currently being implemented.

Thank you for reaching out to us with your concerns. We appreciate hearing from you and we do understand your frustrations. The NNA acknowledges that there are unethical signing services in the marketplace and will bring it to the Signing Professionals Workgroup’s attention. Please understand that the SPW is new and its first priority was publishing the recommended standards for signing agents who interact directly with borrowers at the signing table. The SPW will meet on an ongoing basis to discuss these and similar concerns that relate to the performance of signing services. The SPW is also in the process of creating a Notary Advisory Committee which will be a pipeline for individual Notaries who want to share their input directly with the SPW. We’ll be sure to make that announcement very public as soon as it happens. We’ll also make sure that news is covered on our page (NationalNotary.org/Standards) so I encourage you to visit regularly for updates.

Everyone who is an NNA member should be sending emails regarding this subject. Continuous attention is the only way something is going to get done. We have to rid ourselves of these vermin who do not pay notaries they "hire" (alternate words: Dupe, Fool, Mislead, Cheat, Gyp, Steal From). Whether one likes it or not, there is strength in numbers, and NNA is the organization that has been set up for years. (examples: AARP, American Legion, etc.). Even if you are NOT a member, email or write them.



 
 
My Response to Mortgage Connect

To Whom It May Concern:

It is unfortunate that your company has seen a slowdown in mortgage loans, as has the entire industry. In the corporations that I have worked for, when we have experienced serious slowdowns, we have had to reduce the number of employees, which is what Mortgage Connect should be doing, not attempting to get signings completed for next to nothing. I like the part about sharing your pain. Are your employees accepting a 25% reduction in pay? Is the CEO or President taking a large pay reduction? Savings in operations begins at home. The gas station doesn't give me a discount and neither does the grocery store, even when I tell them it's imperative to participate in cost reductions. They just don't listen.

It is patently obvious that the person within your company who made this ill-considered decision to ask notaries to accept less for the same services, knows nothing about how to run a company or set policy. These kinds of companies are usually doomed to file Chapter 7 or 11. As notaries, we see companies vanish all the time due to inept operation.

You are contracting out for a specific service, which is NOT changing for notaries. I assume (for this $75) that you will still expect notaries to go forth and complete signings in an error-free manner, and expect the same number of copies to be printed (with ever larger loan packages) at the notary's expense. The price of paper and toner has NOT gone down. You expect us to spend our money on gasoline (which has NOT gone down) driving to these signings, not to mention wear and tear on our vehicles. Or do you even care?

You expect the notary to have a background check and Errors and Omissions Policies. These items actually cost money (our money), yet you want the Notary (the person actually contacting the borrower, receiving e-docs (half of the time late), driving to the borrower's home, spending an hour with the borrower, taking your package to FedEx or UPS and returning to the office) to accept LESS money.

Why is that? Truthfully your logic is nonsensical. At the last NNA Convention, companies were extolling the virtues of the notary, saying we are the "crucial" part of the loan process. If we are so crucial, why do you want to only pay $75 - including e-docs - to complete a signing? My printer just burned out it's fuser - $250 to repair it. Who pays that? Or do you even care?

Each notary has to make his/her own decisions. In my estimation, MC's entire premise is child-like and the people making these kinds of edicts are woefully inexperienced in business, and of course as I have said, only time will tell. There will be some dumbos who, sadly enough, don't understand business either, and will blither along accepting........ probably just what they are worth.



 
 
Here's Something New - Can't Wait For This to Go Haywire

Citi Bank recently launched a pricing promotion to their borrowers. A requirement of this promotion is for the borrower to sign an EZ Pay Form during the closing in order to receive this benefit. To identify if this form needs to be executed, a cover letter is placed in the closing package indicating that the loan is part of this pricing promotion. It is important to tell the borrower that he/she is required to complete the EZ Pay Form as part of receiving this promotion. If the borrower refuses to complete this form, we request for you to adjourn the closing and contact ServiceLink immediately.

#1 - Hopefully the loan officer will tell the borrower(s) that the specific loan approval is tied to them accepting the terms of the EZ Pay Form. If he/she does that, not a problem.

#2 - If the borrower(s) refuse to sign, how difficult is it going to be to "contact" someone? My experience in 13 years of doing this, is ...... really difficult. I usually get machines, with no humans attached.

Another thing to be handled by the notary - remember, you are CRUCIAL to the loan closing process - that's what they said at the NNA conference.

In answer to the PM's and posts, here is the revised version of the Letter to the Editor that Mr. Thun indicated he would be including in the next NNA Magazine.

I read with great interest your article entitled "You are Crucial to the Loan Signing Process." I could not agree more. We are crucial. Unfortunately, no one else seems to really believe that. It's one thing to go to a convention and hear these speeches, but in reality they are simply a bunch of words, in my opinion.

The people who are making these speeches are the same people who are NOT paying Notaries what they are worth when the Notary accurately performs the services they were engaged for. Additionally, Notaries are put through numerous hoops due to all of the new regulations caused by the "financial crisis," as they like to call it. This crisis was created by lenders in great part, and some of the same people who also conveniently own title companies and the subsidiary "signing services" they have created.

Notaries have had to take protective action by joining websites to list their experiences, both good and bad, for other Notaries to view in hopes they will keep them from becoming victims of criminal enterprises.

The Notary is crucial, as he or she makes appointment calls, prints documents (often 300 pages at a time due to increasingly bloated loan packages) drives to the signing, spends their time with the borrower, reviews the documents, takes them to FedEx or UPS, drives back to the office and maintains records of every transaction. Yet, for all of this "crucial" work, they only wish to pay a notary $100 for the entire signing including e-docs. Some companies are currently offering notaries $45 to $75 for a signing, including e-docs, which is borderline absurd. This is not proper pay for a "crucial" part of the loan signing process.

Simply stated, what Notaries want to hear is what is going to be done in face of all of these new regulations, and how (and when) is the notary going to be properly compensated? I am talking about the notaries who are out there that are supposedly so "crucial" to the loan signing process.

-----I said sure - the editing wasn't really bad inasmuch as I did get a little wordy (musta been the "passion" of it all) but I suspect they will publish it next edition (hopefully). Since we are so crucial I want to see how this is going to be received by the people that hire us (and occasionally torture us). I nearly barfed when I read this article. For better or worse, here's my response:

The company-owned signing service is merely a stricture in the pipeline to make additional income from the loan process by taking a share of the funds that should go to the notary, the same person that is supposedly so "crucial" to the loan process.

Independent signing services were created for title companies who did not wish to bother obtaining notaries to perform signings. These companies, many of whom, are never, ever vetted by the people hiring them, are often run by people who have no idea of how to run a business. As a result notaries are paid slowly, or not at all. They take a share of the money that should go to a notary, and at times keep it all. Often they go out of business as fast as they appeared, the owners then re-opening other companies with other names and the cycle continues. When non-payment occurs, the notary calls the title company and the complaint falls on deaf ears. Title will continue to use the same signing company.

The notary is crucial, as he or she makes appointment calls, prints 2 sets of documents (often 300 pages at a time due to increasingly bloated loan packages) drives to the signing (gas, tires and general maintenance on the vehicle), spends their time with the borrower, reviews the documents, takes them to FedEx or UPS, drives back to the office and maintains records of every transaction, including collection of unpaid fees by signing companies, including fixing errors made by these companies in fee calculations. Yet, for all of this "crucial" work, they only wish to pay a notary $100 for the entire signing including e-docs. Some companies are currently offering notaries $45 to $75 for a signing, including e-docs, which is borderline absurd. This is not proper pay for a "crucial" part of the loan signing process.

If we are to believe everything that these panel officials state, including your keynote speaker, then it becomes obvious that the notary is not getting paid what he or she should be, while these very companies they represent, bring in millions in profits. If these people believe that a "recognition" speech regarding the notary's role in the loan process is going to inspire all of us to proudly march onward into the future brave new world, they are wrong. The notary needs to be paid for his or her work, but only if it is exactly what they were hired to do. Notary errors need to be dealt with harshly.

All companies have to immediately stop hiring unqualified "notaries" who do not know what they are doing. In short, these companies hiring notaries have to get it together themselves first, and a lot of the problems they experience will diminish. The very companies represented at the conference are the same ones that need to be part of the cure.

Many times assignments are made by people who speak English as a second language and are often unintelligible over the phone - primarily because they work cheaply and often are not even in the United States. This has to stop as well. These companies constantly try to escape properly compensating people involved in the final loan signing process.

Simply stated, what notaries want to hear is what is going to be done in the face of all of these new regulations, and how (and when) is the notary going to be properly compensated? I am talking about the notaries who are out there, that are supposedly so "crucial" to the loan signing process.
