test of your knpwledge of Real Estate documents
Posted by A S Johnson at 12/8/2013 4:59:00 PM
When rules for Real Estate transactions that differ in each state, how can their be a nationwide standard test for SA certification?
The reason for state associations of Notaries with a section for SA.
I think these should be under the supervision of the issuer of Notary commission and SA section should be under the supervision of the governmantal ggency that issue Title/Escrow thier license to work in that state.

Notary law and Real Estate law
Posted by A S Johnson at 11/28/2013 11:31:00 AM
I was at a Thanksgiving dinner and party last night.
Was at a table with my state rep, who is an attorney and 2 other attornies, all have clients that rquire them to handle real estate law in thier praticies. In Texas you MUST have a bar ceritification to handle Title docs. One owns a Title Co.
In or conversations, it became evedient the law requires the borrower be provided with a "exercuted" copy of HELOC documents at the loan closing, but the question was, at the signing or the funding when the signing was done by a Notary in a remote location with the 3 day RTC. Did this refer to the Notarized copy or the one which the Escrow Office had signed off on.
Question, how can a for profit company in one state dicided the meaning of real estate law of another state and enforce their meaning?
P S Poorly written. Sorry. Still trying to understand this.

Mortgage industry standards
Posted by A S Johnson at 11/27/2013 9:29:00 AM
E-mail from xyz:
Christ Sturdivant, xyz Bussiness Development Director, recently answered questions of Marlyand Notaries about the new standards for mortage industry signing.
Question, how is this xyz employee and unbias third party to answer these questions?
Should he not have a disclaimer as to who he is paid by and that he set xyz policy to get it more $$$$.

As I watched some Thanksgiving TV specials, musicains have a standard fee, as do most performers for any apperance, and also set how many must be used for a show, to prevent the use of electronic made sounds, that would put them out of a job, Why are Notaries any different? Are not we as "Professional"? Why can't we set up state unions? Or as lawyers, state associations to supervise any Notary and insurance banking education, testing, commissioning, licensing. Why is this the proviance of a for profit company or an industry managment who benefit from lower fees paid to Notaries or bypassing Notaries all together.
How do these "standards" or security requirements work when documents are sent directly to the borrower who my or my not have a lazer printer or my take them to third party print shop which has not meet the same requirement as Notaries or that them to non- cetrified Notaries for signing, who see the same personal information as we.

National Loan Closing

Signing Service out of Windsor Heights Ia. Recieeved a mass email of their current newsletter, did any of you revieved same.

Below is my responce:
It's nice to know of all the "fun" things your people do with their pay from a job which is a guaranteed income (you wouldn't"t dare slow pay, short pay, have paycheck bounce for a employee). How many of them are Notaries or are Escrow officers?. How many have "paid" from their own income for their background checks?.
Even better will you post the background checks of the ownership and officers of your business.
Now, if one of you clients require background checks from that California company, from their own income, do they pay to become a member of that company, pay for their Notary Certification, pay now to join the NSA section of that company, do their NSA certification before pausing for their background check Cost some $500) Remember that Notary and Escrow officers requirements are state specific.

Background checks

With what is becoming known from the Balitmore Navel Yard shoter investigation, what does it say about how good background checks are in general. Are they really any good or are they a "scam" to "milk" Notaries of their hard earned money?

Hope for Home

Just recieved a "rush" signing. As I couldn't understand them when I answered the phone, I stopped her in mid explination of the assignment, I ask her to stop and answer who she was who she was with. She hung up one me.
Looking up "who called me" on NR, it was a one star service by the name of Hope for Home out of Mora Loma Ca.
Thank you Notary Rotary for let me know I did not miss a assignment from a low ball, slow/NO pay operation.

Notary Direct
Posted by A S Johnson at 8/7/2013 5:34:00 PM
FYI:
I must respectfully decline your less than generous offer. A fee of $20 does not begin to cover the cost of printing. Fed office would price this at around $40 in Ft Worth. I couldn't start my auto for the trip to the location and cover the cost of this assignment. You say it is 7 miles, starting (my) location to where?
For these low fees, do you expect a Notary with a background check and $100,000 of E & O ins?
Sorry, I can NOT quote a fee as I do NOT know the location or size of packet.

the number comes up on who call you as Fort Lauderdale Fl. NO other information.
Job offer very vague.
Weatherford TX has 4 zip codes that cover upwards of 20 miles from Weathercford. So how can you quote a fee.
Also wanted you to pay for return shipping.
Might have fax backs.
But were sure to advise that it was "only" 16 pages with 4 Notraizations.
Any info who tis is.

National Signature Closers

Located in Lenexa Ks
Lender is Flagship Financial located in Lehi UT.
after telling me the package might be around 200 pages and did not know if any faxbacks, I accepted a low ball price of $110 for upto 200 pages and upto 10 faxbacks.
Package arrived with 264 pages, must be printed on legal size paper, and 40 pages of faxkacks.
It was a 5 PM signing and instructed to drop docs in a drop box 10 miles from my normal drop location which is a manned mail and shipping store but with a 5 P M pickup. 20 minutes from the signing location . Plus numerous other instruction that if you did not get them just right, many of which were the lender/ecrow responsibility, you might not get paid.
This was the first set of docs I have returned to signing service in my 15 years of signing. But this was totaly to far of base.
I promised the person I talked with at NSC I would be posting this.

Why question on background checks
Posted by A S Johnson at 6/30/2013 12:31:00 PM
I had three calls recently needing to do notary for re-fi packets.
The customer were printing their own docs and said they did NOT need a lazer printer. Ink jet was OK.
Did Not care when the docs were signed or as required in Texas, date senstive.
Felt they did NOT require a Notary who was background checked.
Felt they did NOT need a Notary who had E & O insurance.
There responce to my fee were that they would take it to their bamk tommorrow to be signed because they would dp it for free.
I know the Federal requirements for background checks but question these Mortgage/Escrow companies, how do they get around there requirements?
Oh! by the way, these are all Mortage companies we all know and have a lot of work from. Only one seemed to be a small, local to thier area, and not known to me.
Just think about being asked by the companies we work for, for specific background check, certain amoumt of E & O insurance, copy of our driver's license, copy of our auto insurance, and a signed independent contractors contract which has a non-complete clause in it.
Just vsnting, but.....
