Missing Papers

I did a signing on the 26th,the mortgage papers had been overnited to me, but I had to print out the title papers. Anyways, the mortgage co. had a binder clip on them so I put it back on them in the return package. I put a small clip on the title ones too. Then I dropped them off in the fedex box. All is normal, right. Well I get a call from the ss today saying the mortgage co. only received the title papers in the envelope, whats going on! Did fedex bust the envelope and only put back in the small set?? Has anyone ever had this to happen to them? I'm wondering what will happen next...

It's possible the mortgage company misplaced the set of docs., but if the docs are not there it seems like you will have to get another set signed by the borrower--wonder if you'll have to eat the cost?

Check the weight of the package you sent to them. A few papers would be under a pound where as a whole package would be way over 2-3 pounds. I know FedEx and UPS both weight all their packages and you can even get that info online with the tracking number. Just an idea to help prove that you did indeed sent them to the company. Good Luck! If it was sent in a FedEx or UPS Legal Envelope then they do not weigh as there is a flat fee for those, as much as you can stuff in the envelope. Good idea if was sent in a Pak.

Paul-IL (must be my evil twin Smiley) said, "a flat fee for those, as much as you can stuff in the envelope."

Not any longer. The maximum weight for "envelopes", whether it be letter or legal size, is 8 ounces for FEDEX. UPS still has no weight limit.

News to me! When I go to use FedEx online and choose FedEx Legal Envelope as packaging I get one price regardless of distance or weight. And that is what is reflected in the invoices as well. Just my own experience mind you.

Look on the back of the "New Reusable Envelope". In red letters, at the top of the liability information paragraph it states, "Weight Limit: 8 Ounces for FedEx Envelope Rate*" and on the left side, under "Limitation on Contents" is the following, "* If the gross weight of the contents, FedEx Envelope, and airbill exceed eight ounces, the next higher rate will apply. Eight ounces is approximately 24 8½" x 14" pages."

Thanks for the info,
I guess FedEx has decided not to charge me those extra weigh fee's at least to date cause I know many of mine have been over that weight and I was only charged the flat rate. Lucky so far I guess :-)

Why would FedEx be charging YOU? When you complete the airbill, you are specifying "bill recipient" or "bill third party" and using the provided account number, aren't you?

And, just to let you know, FedEx is actually charging more for the extra weight. I have one customer that I send legal docs to, not loan docs, and invoice them for the courier fee. If a legal envelope is more than 8 ounces, I'm charged the next weight increase, 1 pound or 2 pounds, depending on what I can cram in those flimsy envelopes. Usually though, I'm under the 8 ounces.

Paul,
I have a few clients that do not provide their FedEx account #'s. I typically charge $25 if I have to use my account. Usually returning up to 100 pages, charge to my account is normally about $16-18 depending on destination. That is standard overnight. I add $20 for Priority Overnight and an additional $20 if they request First Overnight delivery.
I only do this with Lenders or other Title Companies I work with that pay reliabily. I had one company recently try to tell me that they did not give out their UPS number and my fee included shipping the docs back. Sure you can imagine what I told them!

Thanks, Paul. That's good information for my scrapbook of notary tidbits. Sometimes it helps to get ideas like this so you are not totally caught off guard when situations arise.

Typically the docs are returned to the TITLE company. The title company then sends the docs to the mortgage company. Did you send the docs to the mortgage company? If not, then I the problem would lie with the title company, as they are the ones they forward the docs after making the necessary copies and splitting the package according to the lenders settlement instructions.

Often you will receive the lender's docs from the lender via courier and the title company will fax the HUD and "junk" docs. When returning them, I just put them all together in one clip. I even "mix" the documents somewhat for a better presentation to the borrowers, with the majority of the junk docs as the end of the package.

Good idea of checking the weight on the package! Fedex does weigh all the packages, but not ups. The weight was 2 lbs. and I checked on some of my other shipments with the regular amount of papers, they all are in the 2 lb. range. I think you are right, the title co. probable misplaced them. We'll see what else they say today. Thanks to all the responses. When great minds come togather, something good will prevail. YEEHA!

And the end to the story is, the title co. found them.
