Copy of Borrowers Drivers License???

I have my first signing tomorrow for a refi at 4:00PM. It is with Mobile Signing Services in Roseville and I feel good about it because I've read some good things about the company here in the discussions. My question is this:

Under special instructions, it states a copy of the drivers license is requested. I'm trying to figure out how I'm supposed to make a copy. For those who have worked for this SS before, I'd appreciate any advice you can give. Thanks.

Getting a copy of the D.L. is a common request in my neck of the woods. Normally, when I call to confirm the app't with the borrowers, I'll ask them to get a copy of their D.L. so I can send it back with my package. That gives them time to run to town if they need to to make a copy. (Not that they always listen)

If you have a digital camera, take one with you and make the best copy possible if no copy is presented.

I have a good digital camera and HQ lens that makes perfect copies, but have found that in a pinch, even a cell phone camera will do ok given enough light is available.

We should not be getting copy of drivers license I was told that was against the law. The company should provide us with a form that asks you to fill in the information that is located on the ID.

Not illegal in state of California. I search through law sites to no avail and found many other types of industries that require photocopies of driver's licenses and IDs (including mortgage companies and gun dealers).

Thanks for all the responses. I too could not find any legal reference prohibiting copies. I just didn't want to mess up on my first assignment.

So who told you it was against the law? And in what context. I have never heard this and have found no legal ruling to validate your claim.

this statement is totally out of line and it's how what I term 'signing agent misconceptions' are born. Someone reads something once and thinks it's true.

In certain states it's illegal to make copies of licenses - not sure which ones although I THINK Michigan MIGHT be one of them. At my local MBE they wouldn't copy a colored license copy for me - said they could only do it on black and white. Certain lenders (i.e. Chase) don't want copies of licenses. Other lenders have it as a requirement to send in a copy of the license or the loan won't fund. This request is state and lender specific. Just because you've seen or heard it for one specific loan does not make it a general fact.

I am from Michigan. Had a signing for a refinance several weeks ago. There was a request for copies of the borrowers' drivers licenses, which they had complied with. Never thought it might be illegal. Well it was the end of a very long day. Will look into it.

Don't know for sure about D/L but I've been told by several military personnel that military ID cannot be copied.

It is perfectly legal to copy military ID for authorized purposes. Title 18, USC, Section 701 prohibits photographing, reproducing, or possessing Uniformed Services ID cards in an unauthorized manner. Unauthorized use would exist only if the bearer uses the card or copy in a manner that would enable him or her to obtain benefits and privileges to which he or she is not entitled. DoD facilities, as well as Tricare and Champus facilities copy military IDs all the time.
