Signing as both witness and notary?
Vital Signings wants me to sign as a witness on the signature page of a Mortgage along with the second witness. My notarization follows on the next page, declaring the two people who's names I am notarizing. V.S. says it will not be funded or may not be recorded unless there are two witness signatures on the signature page. Is this considered to be proper, signing twice? And if I sign it today when the document is dated a week ago, am I breaking the law? Should the Mortgage be redone?
Thank you for any help you may offer. V.S. is faxing me the signature page tonight to sign and then fax it back.

Shelly, I am a little unclear with your post.
Yes, you can act as a witness & as a Notary, in the state of Florida. Florida does NOT require witnesses on a mtg. The document may not be "date sensitive" so, you can sign it on the day of or days after the doc date. You MUST however, always date your cert. for the day you do the signing.
I'm lost w/ VS is faxing you the doc, though. Are you witnessing after the fact? I don't get it. Please, email me. we can exchange #'s and talk, if you wish.

Hello, A title company ask me to sign as Witness on a NOTE. This was strange, since I have never signed as a Witness on any other note. It must have been a requirement of the state where the mortgage company was located.
Some states require a mortgage to be Witnessed and notrized.

Signing as a witness on the note is a lender requirement. A lender can request you witness almost any documents. HFC, Chase, and Champion come to mind.
