Witness Line on loan docs.

Sorry, I hit the send key before I was ready. I am a new notary signing agent and I am lost. I did a signing yesterday and on some of the docs beside the borrower's signature is the witness line. Well, since we were the only ones there I signed the witness line. Is this okay? or what should I have done. Help!

In California it's not required to have anyone sign that line. Not sure if it's like that in every state.

I'm in New Jersey. Does anyone know if the witness line is required in NJ?

I did a notary signing for my neighbor and didn't have a witness, she later came back to me and said they the lawyer in NJ said it had to have a witness. That is my only experience with NJ. Don't know if that was his idea or the state of NY.

Typically, Deeds and mortgages will have witness lines since some states do require witnesses (see below). Most states do not require witnesses but the lender still may require them. If you sign as a witness and/or have others sign as witnesses, the name of the witness should be clearly printed beneath the signature. In Florida, the deed or mortgage will not record unless the witnesses name is legibly printed under the signature.

2004 State Witness Requirements
-------------------------------
CT - 2 witnesses, one can be the notary
FL - 2 witnesses, one can be the notary - DEEDS OF CONVEYANCE ONLY, not mortgages
GA - 2 witnesses, one MUST be the notary
LA - 2 witnesses, CANNOT be the notary
SC - 2 witnesses, one can be the notary
VT - 2 witnesses, one MUST be the notary

NOTES:
1) FL - Mortgages DO NOT require witnesses, DEEDS (QuitClaim, Warranty, etc.) do
2) MI - witnesses are no longer required
3) Lenders may require witnesses, even though there is no state requirement.
