All Florida Divorce

I imagine a number of you have received emails from MortgageNotary.com in regards to a new business they have started called All Florida Divorce. I do know someone who is utilizing this procedure, though not thru this company. It's very desirable for what might be called "no-fault divorce" where husband and wife are going thru an amicable divorce and no attorney is needed, other than to take a lot of money from them for no reason. It is inexpensive and, typically, divorce papers are issued by the court within 60 days. I utilized this procedure myself in another state. However, I still had to have an attorney do the basic paperwork (and he still tried to bilk me).

MortgageNotary.com is on my list as one of many slow pay companies. They are also charging $200 (for early registration, otherwise it's $300) to attend a seminar to learn the business. This, as we all know, is only the beginning of the expense.

I'm interested in comments, from any of you, as to the potential of this business and any additional feedback in your dealings with MortgageNotary.

Yep, this is what I have been up to!

We have launched a new company here in Florida called All Florida Divorce. We are a non-lawyer document preparation firm specializing in assisting people in divorce document preparation.

First, this is for FLORIDA ONLY! We are not providing our services outside of Florida. I am not trying to discriminate against any other state; however, we are not operating All Florida Divorce outside of Florida as I am not aware of all the laws there regulating document preparation.

Our goal is to provide consumers with an alternative to high attorney's fees. The Florida Supreme Court has approved the use of non-lawyers for the purpose of assisting consumers in the preparation of certain family law forms.

We are presently seeking authorized distributors in all Florida counties who want to offer non-lawyer divorce document preparation services. As an authorized distributor you will operate your own business. You will set your own fees.

You do not need to be a lawyer or even have paralegal training in that our staff will prepare the documents for you. You will simply meet with the client to have the provide their client intake information.

The Florida Supreme Court has noted that at least one person is unrepresented by an attorney in 65% of Florida family law cases. More and more people are deciding to represent themselves. We simply make it possible for them to do so by assisting them in preparing the documents.

I got that too. I am not going to pay 200.00 for this course only because when I got a divorce back in 98, I went to some one like this and the Judge threw half my papers away. Said these people waste your money.

Pam,
My friend's daughter is getting divorced. I downloaded all the documents she needed from the Florida Supreme Court's website and helped her fill them out.

Why anyone would need such a company to prepare the docs when they are freely available at the Florida Supreme Court's website beats me.

Response: You did not use Florida Supreme Court approved documents. They weren't available until 2000 which was after 1998.

I cannot speak as to why you were unable to use the documents that you had prepared; however, I can tell you that the Florida Supreme Court approved documents which began in 2000 and continue to be regularly updated are not the same forms you used.

Thanks Jamie for clearing that up. I may have gone to someone who didn't know what they were doing. Got my divorce anyway. Thank goodness!

One of the reasons the Supreme Court of Florida developed and approved these forms was that they recognized that 65% of family law cases had at least one party that was not represented by an attorney. According to an opinion I read on the subject on their website they approved the forms for continuity and so that it would assist pro se litigants.

What was happening was all kinds of different forms...some not adequate in one manner or another...were being used by pro se litigants.

Today with the Florida Supreme Court approved forms and instructions the pro se litigants are able to help themselves.

Even so, many of my clients come to my office with the forms in their hands. They are willing to pay for someone like me to assist them because they want to make sure the forms are done correctly and/or they don't want to be bothered. As simple as the forms are the whole process is still somewhat intimidating to many. Many just appreciate having someone hold their hand through the process of preparing the documents.

This is pretty simple to understand. Think about it....how many times do you file your tax returns in your life? And, now there are pretty good software programs that make it even easier. Yet, many people still use tax form preparers.

People don't file divorce every years. They are seeking assistance.

Run, run, run from this company. Bad rep on many notary boards. Very slow pay.
