If the borrower does not sign and request a copy of the loan is it okay to leave a copy?

You need to ask the lender first, but I never leave a copy of it. They have not paid for it for starters and that's how some title/lenders look at it. And if they are not signing, then they don't need their copy. If they want a copy of the docs, then let them contact the LO and have he/she send them a copy of it which will probably not going to happen. Most lenders want both copies back, or expect you to shred both copies if the borrowers don't sign. But call then lender/title company during the signing and ask first if in doubt.

I don't leave a copy based on they did not sign the docs so I don't feel that technically they are the borrowers to have.

I never leave the full package of copies if they do not sign, but if the problem pertains to the HUD or another specific document then I would leave just that document(s) and my business card. This usually helps the borrower to correct the issues and then they usually request from the lender to have me back to complete the signing, since they have my business card to remember who I am! This is what works for me and I have never had any complaints from lenders or title/escrow on doing this. BK-FL

A company called AMTS out of Sacramento, CA asked me to travel 60 miles to perform a signing. The borrower did not sign. The signing order states "didn't sign, Fees remain the same". This was in Aug. 2004 and I have still not been paid. HOwever I did document my telephone calls, used the demand letter template provided by either NNA or Notary Rotary requesting payment and still no response. I did file a complaint with the BBB on line.

You also may want to file complaints against signing companies that do not pay. Together we are strong and hopefully make getting paid easier.

Angela On your signing order from AMTS the cell phone of Berconia (AMTS owner) is given. I called her and it looks like I will get paid. Just a suggestion. If you don't have it, I have both her cell and her email. She did come across as helpful.

Thank you. Did you call her because you were having trouble getting paid? You said looks like I'll be getting paid, does that mean you have not yet been paid?

I've called and written. I just left a msg for Beronica @916-628-7 per your suggestion. I'll keep you posted.
