Lost Documents

Here's one for you. I did a signing for a large Title Co back East on Wednesday before Thanksgiving. Sent docs back the same afternoon. Got a call today from the lender who asked me where the documents were. I said I shipped them to the Title Co. Told her I had checked Fed Ex site for tracking # and they were delivered on Friday.

She said the title Co said loan did not close. Called title Co left a message to call me back, they did and were asking me where are the documents?? I said you have them, I checked tracking #, they say they can't find them. Their tone sounded like it was my fault and am I sure I did the signing??

Then she tells me this is a new client of theirs and don't want to screw up, can I meet with borrower to sign again. I say sure, and she tells me I need to date docs with original date!!
I say no can do, thats back dating, and she says no it isn't you signed the original loan on that date so it's not backdating!!! I said the borrower can put any date they want, but I have to put the right date on my certificates. She said " that won't help me", and hung up.

What is wrong with these companies? She is gonna throw me to the wolves to save her client. I wonder now if they are gonna even pay me?? What do you all think?

Jan,

I can enlighten you as to why they wanted the docs dated Wednesday. It all relates to the right of rescission and the end of the month rush. For Wednesday, there was a five day right of rescission (with Thanksgiving and the following sunday). The rescisssion period ran midnight on Monday night, the 29th. Thus the loan could fund today on the thirtieth, the last day of November. Any other (later) date and it wouldn't fund this month.

Jan,
In checking the tracking info, did you see who signed for the package? I never sign the release box to deliver the package without obtaining a signature.

Yes it was signed for by a receptionist. I always make sure to get a signature for that reason. It was just so strange the way they were acting.

I'm glad you got the signature showing the receptionist accepted it. If they have lost the package, they have cause to act strange. Of course, it's easier for them to put the blame off on you than to actually admit that it is their fault. Stick to your guns -- you did everything correctly. Now all you have to worry about is getting paid, since they have screwed it up on their end.

Those docs will eventually show up in that office. I'm sure it was quite chaotic due to the holiday and they'll be found on someone's desk.

I'd also suggest that you definitely think hard about whether you want to do any future work for this company. That they seem to try to blame you, even after you provided them with a tracking number showing delivery, plus tried to get you to do something that they KNOW is illegal tells me that ethics are not a huge priority with them.

I work for a City Entity and we do demands for payment to title co and lien releases for paid debts, it seems to me as if they don't follow through and sometimes it appears as if one end doesn't know what the other end is doing. I have had one title company call me about a lien release that was prepared and submitted in 2002, 2x in 2003, and 1x in 2004 for the same APN/taxpayer, the last 3 times, I sent the Lien release certified mail and faxed it to them.
