This is a "What would you do?" situation. I received a deed of trust today to be recorded at my local courthouse. Before submitting it, I checked it over and found that the Register of Deeds would not accept it because the notary acknowledgement did not contain the full and correct names of the borrowers (read John & Martha Smith, rather than John Q Smith and Martha Lee Smith). I called my contact for instructions, and was passed on to the title company who closed the loan. Do any of you see an ethical problem with me marketing to this title company? Seems like a great prospect to me.

A title recording service out of Sacramento CA. They are similar to a signing service for abstractors to get docs recorded.

they are a title recording firm, hiring you to record the document. You're a signing agent offering signing services... market away!

I agree Ninna.

In fact, I have recently been marking out the non-compete portions of the contracts I send in. One recently required that you not accept work for their clients if I have not already worked for the client.

How the heck can you do that after you have done many, many signings and schedule appointments on the fly? Would they really want us to stop and check a list of everyone we have ever worked for before we accept an assignment.

Many of the contracts the ss have don't make any sense at all. If a ss looses a client and someone else gets the contract are we suppose to turn it down? One contract I was asked to sign stated that i would not do work for their clients for 3 years if the assignment did not come directly from that particular ss, they also required me to send in copy of dl ss and all my info. I declined signing the contract, in fact I don't like signing thees contracts at all.
I understand they don't want us to market our selfs directly to their customers, apart from that I don't think we should be signing anything. We are free agents doing work upon request. regardless of who is requesting the assignment.
