Name/Sig affidavit

Anyone ever have this with like 5 names, 4 of them are not even close to what the borrower has EVER gone by?? I have this happen all the time, and they don't want to sign a name which is not thiers... I don't blame them... but this time the title co. doesn't like that they didn't sign some of the names... Not much I can do about that... What would you do in that situation ?

If it isn't their name I have the BR put a N/A on the signature line.

Example:
John Q. Public signature
aka
J. Quenten Public Jr. signature
John P. Quenten N/A
John Q. Public III N/A
John Public signature

Yes, that is what I have them do, but this time she was like well why couldn't they just sign it..... Yeah, lets turn the tables and guarantee they wouldn't do it. Crazy folks... Smiley

Tell her that the borrowers are under oath and will not swear that they are a name they never use. They would be committing perjury which is a big No-No - that is why they just couldn't sign it.

I have the borrower write a statement beside each name they have never been known by as follows: "I have never used or been known by this name" and have them initial.

I had a similar situation last month. Borrower's first name is Mike and there was an AKA Mile for him to sign and me to notarize. Borrower never went by Mile and believe it is a typo but TC did not allow him to correct it or cross it out. Borrower was so pissed....I mean all kinds of 4 letter words (some in foreign language) came out of his mouth!

In my experience, these weird AKAs poped up in their credit report and the Lender or TC can't do anything about it. If the borrower refuse to sign, they have to resolve it with the credit bureaus - which takes time and they will have to shelve their loan ap.
