Notarization from out of state resident ?.

I had a signing ocmpany call me today to do a notarization for an out of state resident. I live in NJ right on the NJ/DE boarder. The signing company asked me if I could do a notarization if the DE resident drove over the boarder into NJ and I notarized the documents in NJ. DE apparently is an attorney state. Whats everyone thoughts on this. Should I do it or shouldnt I?

DO IT !!!

I, an several other notaries (with proper MD licenses), do it all the time for DE residents.
Make sure you charge enough. They are avoiding a lawyer bill in DE.

Yes, do it. As long as you are in the state of your commission, you could notarize a space alien, as long as he has current ID.

I do notarizations for signers who don't reside in my state all the time. As long the signer is in your state of commission it's okay.

Space alien's carry "Out of Space" IDs. They list their planet vs. their state. As long as they beam down to Earth and pay the appropriate fee, I'll do the signing. But, they have to resemble their photo and their signature has to match. LOL

But Dee, that is not on the list of acceptible ID in Florida, they would have to have a passportSmiley

I keep a list of which states require witness. Then when I do a closing for property in other states, I can be sure there are enough witness.

In MD I don't need witnesses. But, if the property is in CT,FL,GA,LA,MI,NE or SC I get witnesses as needed.

As far as I know, your list is outdated. The following is what I have:

2005 State Witness Requirements
-------------------------------
CT - 2 witnesses, one can be the notary
FL - 2 witnesses, one can be the notary - DEEDS OF CONVEYANCE ONLY, not mortgages
GA - 2 witnesses, one MUST be the notary
LA - 2 witnesses, CANNOT be the notary
SC - 2 witnesses, one can be the notary

NOTES:
1) FL - Mortgages DO NOT require witnesses, DEEDS (QuitClaim, Warranty, etc.) do.
2) VT - Effective 7/1/04, Act 150, Sec. 1.27 V.S.A. §2 was amended to remove witness requirements.
3) Lenders may require witnesses, even though there is no state requirement.

MI did away with the requirement in 2003.
I don't believe NE requires witnesses, but if someone can show me the light, I certainly will add them to my list. (Any NE notaries out there that can confirm or deny the requirement?)

Nope - can't use it - toysrus are not a recognized government entity to issue passports.
